HomeMy WebLinkAboutOrdinance No. 550 CITY OF THE COLONY, TEX~ ORDINANCE NO. 550 AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS AMENDING CHAPTER 4 OF THE CODE OF ORDINANCES RELATING TO AMUSEMENTS BY AMENDING SECTION. 4-29 OF CHAPTER 4 RELATING TOTHE HOURS OF OPERATION OF AMUSEMENT GANES~ PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES OF THE CITY EXCEPT TO THE EXTENT OF CONFLICT HEREWITH~ PROVIDING A SEVERABILITY CLAUSE~ PROVIDING A pENALTY NOT TO EXCEED FIVE HUNDP~ED DOLLARS ($500.00} FOR EACH OFFENSE AND A SEPARATE OFFENSE SRATJ' HE DEEMED COMMITTED UPON EACH DAY DURING OR ON WHICH A VIOLATION OCCURS~ DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE WHEREAS, the City Council of the City of The Colony, Texas recognizes that minors are without parental or other adult supervision during the late hours of the night and early hours of the morning~ and WHHREAS, the City Council further recognizes that coin- operated amusement devices and billiard tables, as those terms are defined in Section 4-20 of the Code of Ordinances of the City, constitute an attraction for minors and a reason for them to remain out during late night and early morning hours~ and WHEREAS, the City desires to protect the health, safety and welfare of such minors and all of its citizens and finds that restricting the hours of use of coin-operated amusement devices and billiard tables will help to create a safer environment in the City for minors and protect the health, safety and welfare of all citizens of the City. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: Section 1. That all of the findings contained in the preamble are found to be true and correct and the City Council does hereby incorporate said findings into the body of this Ordinance as if copied in their entirety. Section 2. That Chapter 4 of the Code of Ordinances of the City of The Colony, Texas relating to amusements is hereby amended in the following particulars and all other existing sections, subsections, paragraphs, sentences, definitions, phrases and words of said Code are amended but are hereby ratified, verified and affirmed~ A. That Section 4-29 of said Chapter 4 relating to hours of operation of a business licensed to provide amusement games or billiard tables on their premises shall be and is hereby amended to read as follows: "Section 4-29. Hours of Operation - Premises licensed under the terms of this article may permit the operation of coin-operated amusement devices or billiard tables between the hours of 7:00 a.m. through 12:00 midnight, Monday through Wednesday~ 7.:00 a.m. Thursday through 2:00 a.m. Friday~ 7:00 a.m. Friday through 2:00 a.m. Saturday~ 7:00 a.m. Saturday through 2:00 a.m. Sunday~ 1:00 p.m. Sunday through 12:00 midnight~ and between the hours of 7:00 a.m. December 31 and 2:00 a.m. January 1, regardless of the day on which January 1 falls." Section 3. That this ordinance shall be cumulative of all other ordinances of the City affecting amusement games and shall not repeal any of the provisions of said ordinances except in those instances where provisions of those ordinances are in direct conflict with the provisions of this ordinance. Section 4. If any sentence, article, paragraph, clause, phrase or word in this Ordinance, or application thereof to any person or circumstances is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not effect the validity of the remaining portions of this Ordinance; and the City Council hereby declares it would have passed such remaining portions of this Ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 5. Any person violating any of the provisions of this Ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum' not to exceed Five Hundred Dollars ($500.00) for each offense and a separate offense shall be deemed committed upon each day during or on which a violation occurs or continues. Section 6. The fact that the present ordinances and regulations of the City are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the inhabitants of the City creates an emergency for the immediate preservation of the public business, property, health, safety and general welfare of the public which requires that this Ordinance shall become effective from and after the date of its final passage and publication as provided by law, and it so accordingly so ordained.
