HomeMy WebLinkAboutOrdinance No. 556 CITY OF C~ COAONY, TEXAS ORDINANCE NO. 556 AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS PROVIDING SETTING A PUBLIC HEARING DATE TO DISCUSS THE ADOPTION OF A CAPITAL IMPROVEMENTS PLAN AND TO DISCUSS THE IMPOSITION OF IMPACT FEES PURSUANT TO LEGISLATION RELATING TO FINANCING OF CAPITAL IMPROVEMENTS BY POLITICAL SUBDIVISIONS; PROVIDING A TIME AND PLACE FOR SAID PUBLIC HEARING, TO-WIT: ON THE 21ST DAY OF NOVEMBER, 1988, AT 7:30 O'CLOCK P.M. AT THE COLONY CITY HALL; PROVIDING FOR NOTICE; AND DECLARING AN EFFECTIVE DATE NOW, THEREFORE, BE IT ORDAINED BY TI{E CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: Section 1. That the City Council of the City of The Colony, Texas finds that Section 3(b) of Senate Bill 336 does require a public hearing date be established to discuss the adoption of a capital improvements plan to and to discuss the imposition of impact fees pursuant to legislation relating to financing capital improvements by political subdivisions. Section 2. That the City Council hereby declares a Public Hearing shall be held on the 21st day of November, 1988, at 7:30 p.m. at City Hall, to discuss a capital improvements plan, and the imposition of impact fees. Section 3. That public notice shall be given by publication of the hour, date, and place of such hearing once a week for three consecutive weeks, the first notice to appear at least 30, but not more than 60 days before the date set for the hearing, in one or more newspapers with general circulation in Denton County. And, at least 30 days before the hearing, notice of the hearing shall be sent by certified mail to any person who has given written notice by certified or registered mail to the City Secretary requesting notice of such hearing within two years preceding the date of adoption of this ordinance. Section 4. The necessity for holding a Public Hearing to discuss the adoption of a capital improvments plan and the imposition of impact fees, as required by Senate Bill 336, requires that this ordinance shall take effect immediately from and after its passage, as the law in such cases provides.
