FOR VEHICLES UNDER THE PROVISIONS OF SECTION 169(b) OF ARTICLE
6701 d, VERNON'S TEXAS CIVIL STATUTES, UPON FARM ROAD HIGHWAY
NUMBER 423 OR PARTS THEREOF, WITHIN THE INCORPORATE LIMITS OF
THE CITY OF THE COLONY, AS SET OUT IN THIS ORDINANCE; AND
PRO¥IDING A PENALTY OF A FINE NOT TO EXCEED $200.00 FOR THE
VIOLATION OF THIS ORDINANCE.
WHEREAS, Section 169(b) of Article 6701 d, Vernon's
Texas Civil Statutes, provides that whenever the governing
body of the City shall determine upon the basis of an
engineering and traffic investigation that any prima facie
speed therein set forth is greater or less than is reasonable
or safe under the conditions found to exist at any intersection
or other place or upon any part of a street or highway within
the City, taking into consideration the width and conditioning
of the pavement and other circumstances on such portion of said
street or highway, as well as the usual traffic thereon, said
governing body may determine and declare a reasonable and safe
prima facie speed limit thereat or thereon by the passage of
an ordinance, which shall be effective when appropriate signs
giving notice thereof are erected at such intersection or other
place of part of the street or highway~
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY:
SECTION 1. Upon the basis of an engineering and traffic
investigation heretofore made as authorized by the provisions
of Section 169(b) of Article 6701 d, Vernon's Texas Civil
Statutes, the following prima facie speed limits hereafter
indicated for vehicles are hereby determined and declared
to be reasonable and safe; and such speed limits are hereby
fixed at the rate of speed indicated for vehicles traveling
upon the named streets and highways, or parts thereof, described
as follows:
That from and after the date of the passage of
this speed zone ordinance no motor vehicle shall
be operated along and upon Farm Road Highway No.
423 within the corporate limits of the City of
The Colony in excess of the speeds now set forth
in the following limits. Beginning at said point
being the North City Limits of the City of The
Colony on Farm Road 423, thence continuing in a
Southerly direction for a distance of 0.341 mile
(1,800 feet), approximately, a maximum spedd of
thirty (30) miles per hour when so signed for
school crossing locations. Said speed limits
shall be in effect on school days from the hours
of 7:30 A.M. to 9:00 A.M., from 11:30 A.M..,to
1:00 P.M., and from 2:30 P.M. to 4:00 P.M.
SECTION 2. The Traffic Administrator of the City of The
Colony is hereby authorized to cause to be erected, appropriate
signs indicating such speed zone.
SECTION 3. Any person violating any of the provisions
of this ordinance shall be deemed guilty of a misdemeanor
and upon conviction thereof shall be fined in any sum not to
exceed Two Hundred Dollars ($200.00).
SECTION 4. The opening date of the public schools in
the City of The Colony, August 26, 1982, creates an emergency
in the preservation of the public health and welfare and
requires that this ordinance be passed as an emergency
ordinance in accordance with Section 3.10 of the Home Rule
Charter.
SECTION 5. This ordinance shall become effective from and
after its passage and the publication of the caption as the
law and charter in such cases provide.
