AN ORDINANCE OF THE CITY OF ~FHE COLONY, TEXAS, PROVIDING FOR THE GIVING OF TWO YEARS ADVANCE NOTICE IN WRITING 'FO THE SECRETARY OF HEALTH, EDUCATION & WELFARE AND THE EMPLOYEES RETIREMENT SYSTEM OF TEXAS TO TERMINATE THE CI?Y~S AGREEMENT FOR PARTICIPATION IN THE SOCIAL SECURITY SYSTEM FOR CITY EMPLOYEES; PROVIDING FOR TERMINATION, EFFECTIVE AT THE END OF THE LAST CALENDAR QUARTER OF 1984; REPEALING ORDINANCE NO. 14 OF THE CITY OF THE COLONY EFFECTIVE AT THE END OF THE LAST CALENDAR QUARTER OF 1984; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of The Colony authorized, by Ordinanee agreements with the Employees Retirement System of Texas relative to Federal Old Age, Survivors~ Disability and Health Insuranee Benefits under the provisions of applieable State and Federal laws; and, WHEREAS, said ordinance took effect on August ~, ~977; and, WHEREAS, the City Couneil of the City of The Colony now desires to terminate said agreements and give notice as re¢Iuired by federal law of such termination effective at the end of calendar year ~984; and, WHEREAS, the agreements with the Employees Retirement System of Texas have been in effeet for not less than five years as of the date notice is reeeived by the Seeretary of Health, Edueation & Welfare; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY~ TEXAS: SECTION ~. The City of The Colony hereby determines and de~lares to terminate~ effective at the end of ~alendar year 1984~ its agreements with the EmDloyees Retirement System of Texas relative to Federal Old Age, Survivors, Disability and Health Insuranoe Benefits under the provisions of applicable State and Federal laws. SECTION 2. This termination is of the agreements in their entirety, said agreements having been in effect from their effective date for not less than five years prior to the effective date hereof. SECTION 3. That the provisions of Ordinance No. 14 shall be repealed as of the end of calendar year 1984. SECTION 4. That the City Secretary is directed to forward to the Secretary of Health, Education & Welfare and to the Employees Retirement System of Texas a certified copy of this ordinance to serve as the notice required to be given in writing by the provisions of 42 USCA, Section 418(g)(1) also known as Title II, Section 218, of the Social Security Act, as amended. SECTION 5. This ordinance shall take effect immediately from and after its passage as the law and charter in such eases provide.
