HomeMy WebLinkAboutOrdinance No. 208 ORDINANCH NO. ~ AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, AMENDING SECTION 307 OF THE BUILDING CODE OF THE CITY OF THE COLONY; REQUIRING A CERTIFICATE OF OCCUPANCY FOR A CHANGE OF OWNERSHIP OR OCCUPANCY OF A RESIDENTIAL DWELLING UNIT; PROVIDING A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE; AND PROVIDING AN EFFECTIVE DATE. WHI/RI/AS, the City Council adopted the 1979 edition of the Uniform Building Code as the Building Code of the City of The Colony by Ordinance No. 120; and, WHEREAS, it is necessary to require a certificate of occupancy upon change of ownership or change of occupancy of a residential dwelling unit, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: SECTION 1. That Section 307 of the 1979 edition of the Uniform Building Code, of the International Conference of Building Officials, is hereby amended by adding subparagraph (f) as follows, to-wit: "Section 307(f). Group R Occupancy. Upon a change of ownership or a change of occupancy in a residential dwelling unit, the owner, his agent or the oeeupant shall request a certificate of occupancy from the Building Official of the City of The Colony. The Building Official or his authorized representative shall issue a certificate of occupancy stating that the residential dwelling unlt~mplies with the requirements of the Minimum Housing Code of the City of The Colony or shall direct the owner to take such action as is required to bring the building and premises into compliance with the Minimum Housing Code before it can be occupied." SECTION 2. Any person, firm or corporation violating any of the provisions of this ordinance or of the Building Code of the City of The Colony as amended hereby shall be deemed guilty of a misdemeanor, and upon conviction in the Municipal Court of the City of The Colony, shall be subject to a fine not to exceed the sum of Two Hundred Dollars ($200.00) for each offense, snd each and every day any such violation shall continue shall be deemed to constitute a separate offense. SECTION 3. This ordinance shall take effect immediately from and after its passage and the publication of the caption as the law and charter in such eases provide.
