HomeMy WebLinkAboutOrdinance No. 172 AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, ADOPTING THE NATIONAL ELECTRICAL CODE, 1981 EDITION, PUBLISHED BY THE NATIONAL FIRE PROTECTION ASSOCIATION; PROVIDING AMENDMENTS; PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE; REPEALING ALL ORDINANCES IN CONFLICT; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: SECTION 1. That the National Electrical Code, 1981 Edition, published by the National Fire Protection Association, be, and the same is hereby, adopted as the electrical code of the City of The Colony, Texas. SECTION 2. That the following are hereby adopted as amendments to the 1981 Edition of the National Electrical Code adopted by this ordinance and such amendments shall be and become a part of the Code as adopted hereby, to-wit: 1. Ail wiring systems shall be installed in a raceway, except where permitted by the Code in dwellings. 2. GFCI protection shall not be required on construction sites. 3a. With the exception of Bussbars and Bussways ail wiring material shall be of copper if smaller than number 6 AWG. 3b. Aluminum wire shall not be used for branch circuits. 4. The service disconnecting means shall be required outside at the meter location for all multi-family dwellings. 5. Supplementary grounding shall not be required for the grounding electrode system where twenty feet of metal water pipe is installed in direct contact with the earth. 6. There shall be no less than two duplex receptacles in each livable room of an existing dwelling unit. 7. Minimum ampacity for service entrance conductors for total electric one-family dwallings. a) residential occupancy with 10 kw furnace: 150 amperes service b) residential occupancy with 15 kw furnace: 175 amperes service c) residential occupancy with 20 kw furnace: 200 amperes service d) residential occupancy with 25 kw furnace: 250 amperes service e) residential occupancy with 30 kw furnace: 250 amperes service f) residential occupancy with 35 kw furnace: 275 amperes service (size all other services accordingly) SECTION 3. That any person, firm or corporation violating any of the provisions of this ordinance or of the 1981 National Electrical Code as adopted hereby shall be deemed guilty of a misdemeanor, and, upon conviction in the Municipal Court of the City of The Colony, Texas, shall be fined in an amount not to exceed the sum of Two Hundred Dollars ($200.00) for each offense and each and every day such offense shall continue shall be deemed to constitute a separate offense. SECTION 4. Any and all ordinances of the City of The Colony in conflict with the provisions of the 1981 National Electrical Code as adopted and amended herein are hereby repealed. SECTION 5. That the provisions of this ordinance and the 1981 National Electrical Code are declared to be severable and should any provision of the Code or this ordinance be held to be invalid for any reason, such holding shall not affect the remaining portions of the Code or this ordinance not so declared. SECTION 6. A true copy of the 1981 National Electrical Code as published by the National Fire Protection Association is incorporated herein by reference and attached hereto as Exhibit "A", and a true and correct copy of the Code shall be kept with the original of this ordinance in the office of the City Secretary at all times and shall be available for public inspection at all times during regular business hours. SECTION 7. This ordinance shall take effect immediately from and after its passage and the publication of the caption as the law and charter in such cases provide.
