AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, SUSPENDING THE
EFFECTIVE DATE OF THE PROPOSED REVISIONS OF RESIDENTIAL AND
COMMERCIAL GAS RATES OF LONE STAR GAS COMPANY FOR ONE HUNDRED
TWENTY (120) DAYS FROM OCTOBER 9, 1981; PROVIDING THAT THE RATES OF
SAID PUBLIC UTILITY SHALL REMAIN UNCHANGED DURING THE PERIOD OF
SUSPENSION; AND PROVIDING FOR NOTICE HEREOF TO SAID PUBLIC UTILITY.
WHEREAS, Lone Star Gas Company, a Division of ENSERCH CORPORATION,
heretofore, on September 3, 1981, filed with the City Secretary a Statement of Intent
to Change Rates for gas service provided by it within the corporate limits of the City
and proposed that the revised residential and commercial rates become effective on
October 9, 1981; and,
WHEREAS, the City Council of the City of The Colony is of the opinion and
finds that there is a necessity to consider a large amount of data in connection with
the request and that there is a necessity for public hearings thereon prior to final
determination of the rate request, and consequently that the operation and effective
date of the proposed schedule of rates should be suspended for final determination of
the rate request; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY,
TEXAS:
SECTION 1.
The effective date of the proposed revision of residential and commercial rates
of Lone Star Gas Company, a Division of ENSERCH CORPORATION, for gas service
within the City of The Colony, heretofore filed on September 3, 1981, is hereby
suspended for a period of one hundred twenty (120) days from October 9, 1981. The
reason for such suspension is to provide additional time for the staff and Council to
consider the large amount of data filed in connection with the request, to give notice
of and hold public hearings thereon prior to final determination of the request for the
purpose of determining the propriety of the rate increase requested.
SECTION 2.
The rates of Lone Star Gas Company for gas service within the City in effect
on September 3, 1981, shall continue in force during the period of suspension as provided
in Section 1. The City Council hereby declines to fix any temporary rates for the
period of suspension.
SECTION 3.
The City Secretary is hereby directed, promptly after the passage of this
ordinance, to furnish a copy hereof to Lone Star Gas Company through its authorized
representative who filed the Statement of Intent.
SECTION 4.
This ordinance shall become effective immediately from and after its passage
as the law in such cases provides.
DULY PASSED by the City Council of the City of The Colony, Texas, on the
day of September, 1981.
