HomeMy WebLinkAboutOrdinance No. 186 AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, AMENDING ORDINANCE NO. 178 BY ADDING SUBDIVISION 1.300 H, SUBSECTION 5; PROVIDING FOR THE LOCATION OF OFF-PREMISE SIGNS IN AGRICULTURAL, LIGHT COMMERCIAL, HEAVY COMMERCIAL AND INDUSTRIAL ZONES ONLY; PROVIDING REGULATIONS FOR OFF-PREMISE SIGNS; PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: SECTION 1. That Section 1.300 H of Ordinance No. 178 of the City of The Colony be, and the same is hereby, amended to add subsection 5 as follows, to-wit: "5. Off-premise signs ore permitted in Agricultural, Light Commercial, Heavy Commercial, and Industrial zoned districts of the City, but are prohibited in all other zoning districts. No off-premise sign in any of said districts shall exceed one hundred fifty (150) square feet in area. No off-premise sign may be located nearer than three hundred (300) feet from any other off-premise sign within the City and permitted under this ordinance. This requirement shall not apply to signs which ore situated on the same billboard or pole and which are in fact back-to-bacK signs. No off-premise sign shall exceed twenty (20) feet in height at its highest point." SECTION 2. Any person, firm or corporation violating uny of the provisions of this ordinance shall be deemed guilty of a misdemeanor and, upon conviction in the Municipal Court of the City of The Colony, Texas, shall be fined in an amount not to exceed the sum of Two Hundred Dollars ($200.00) for each offense, and each and every day any such violation shall continue shall be deemed to constitute a separate offense. SECTION 3. The provisions of this ordinance are severable, and if any portion of this ordinance shall be deemed unconstitutional or invalid for any reason, such declaration shall not affect any of the remaining portions of this ordinance not so declared. SECTION 4. This ordinance shall become effective immediately from and after its passage and the publication of the caption as the law and charter in such cases provide.
