HomeMy WebLinkAboutOrdinance No. 236 AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, ANNEXING THE HEREINAFTER DESCRIBED TERRITORY TO THE CITY OF THE COLONY, TEXAS, AND EXTENDING THE BOUNDARY LINES OF SAID CITY SO AS TO INCLUDE SAID HEREINAFTER DESCRIBED TERRITORY WITHIN SAID CITY LIMITS; GRANTING TO ALL INHABITANTS AND OWNERS OF PROPERTY ALL OF THE RIGHTS AND PRIVILEGES OF OTHER CITIZENS AND BINDING THE INHABITANTS BY ALL THE ACTS, ORDINANCES AND REGULATIONS OF SAID CITY; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. I~IEREA~, after development and presentation of a service plan for the hereinafter described property and after holding the public hearings required under the provisions of Article 970a of the Revised Civil Statutes of the State of Texas; and, WHEREAS, the following described territory is land adjoining the present City limits of the City of The Colony, and the members of the City Council of the City of The Colony have concluded that said area should be annexed and made a part of the City of The Colony, Texas, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: SECTION 1. That the following described territory be, and the same is hereby, annexed to the City of The Colony, Texas, and the boundary limits of the City of The Colony be, and the same are hereby, extended to include the following described territory within the City limits, and the same hereafter shall be included within the territorial limits of said city, and the inhabitants thereof hereafter shall be entitled to all rights, privileges and responsibilities of citizens of the City and shall be bound by the acts, ordinances, resolutions and regulations of the City. SECTION 2. That the territory annexed hereby is more particularly described in Exhibit "A" attached hereto and made a part hereof for all purposes. That upon passage hereof, the boundary limits of the City shall thereafter be as fixed in all previous annexation ordinances plus the additional territory annexed hereby, and hereafter the same shall be a part of the City of The Colony and the property situated therein shall bear its pro rata part of the taxes levied by the City. SECTION 3. That the approved service plan is attached hereto as Exhibit "B" and is approved as a part hereof. SECTION 4. That it is not the intention of the City of The Colony to annex any territory not legally subject to being annexed by said City, and should any portion of the territory described in Exhibit "A" not be subject to legal annexation by the City of The Colony, such fact will not prevent the City from annexing said territory which is described therein and is subject to legal annexation, it being the intention of the City to annex only such territory as may be legally annexed by it within the limits of such area. SECTION 5. This ordinance shall take effect immediately from and after its passage as the law and charter in such cases provide. B. B. & C. R. R. Co. Survey, Abstract No. 182, the Richard G. Dunlap Survey~ Abstract No. 352, and the J. C. Canton Survey, Abstract No. 313, said 82.974 acre tract being more particularly described as follows: COMMENCING at the northeast corner of said B. B. B. & C. R. R. Co. Survey, said point being the southmost southeast corner of the James Robertson Survey, Abstract No. 1507; THENCE South along the east llne of said B. B. B. & C. R. R. Co. Survey, a distance of 27168.0 feet to a point on the arc of a curve whose center bears South 27 degrees 26 minutes 50 seconds East a distance of 2,720.0 feet having a central angle of 19 degrees 02 minutes 26 seconds and a tangent length of 456.2 feet; THENCE along said curve an arc distance of 903.9 feet to the POINT OF BEGINNING; THENCE continuing along same said curve having a central angle of 20 degrees 59 minutes 19 seconds, a tangent length of 503.8 feet and an arc length of 996.4 feet to the point of ta~gency of said c~rve; THENCE South 22 'degrees 31 minutes 25 seconds West a distance of 2,198.6 feet to the p6int of curvature of a curve to the left having a central angle of 76 degrees 47 minutes 25 seconds, a radius of 2,720.0 feet and a tangent length of 2,155.5 feet; THENCE along said curve to the left an arc length of 3,645.5 feet to a point in the west line of Colony No. 29, an addition to the City of The Colony; THENCE along sa{d west line of Colony No. 29, South O0 degrees 20 minutes 45 seconds East a distance of 595.0 feet to a point on the arc of a circular curve to the right whose center bears North 29 degrees 29 minutes 10 seconds East a distance of 3,220.0 feet, having a central angle of 83 degrees 02 minutes 15 seconds and a tangent length of 2,850.7 feet; THENCE along said curve to the right a distance of 4,666.7 feet to the point of tangency of said curve; THENCE North 22 degrees 31 minutes 25 seconds East a distance of 2,198.6 feet to the point of curvature of a curve to the right~ having a central angle of 13 degrees 25'minutes 31 seconds, a radius of 3,220.0 feet and a tangent length of 379.0 feet; THENCE along said curve to the right an arc length of 754.5 feet to a point for corner; THENCE South 88 degrees 24 minutes 38 seconds East a distance of 634.3 feet to the POINT OF BEGINNING and containing 82.974 acres of land, more or less. SERVICE PLAN Service plan for 82.974 acre land tract generally located on the western City Limit line on Stewarts Creek Peninsula and extending due north In accordance with 970A Section 10B VACS the following is a state- ment of governmental services that must be provided in sixty days and capital improvements that must be provided in two and one-half years. 1. Presently the City does have a contract with Denton County to provide fire protection to this area and this service will be continued. Ambulance service can be provided immediately. This ]and is not developed, and there are a few residents on the "Northrup" property which is located on Stewarts Creek Peninsula. A large number of medical calls is not expected. 2. The Police Department will review immediately the provision of a new district which will provide for patrol of this area based on need. 3. Waste collection is presently not needed except on the Northrup property. 4. Road and park maintenance can be maintained. There are no recreational facilities on this land. 5. No capital improvements, i.e., streets, fire station, etc., are needed until it is subdivided and developed. Exhibit "B"
