UNIFORM BUILDING CODE, 1979 EDITION, OF THE INTERNATIONAL CONFERENCE
OF BUILDING OFFICIALS, HERETOFORE ADOPTED BY ORDINANCE NO. 120, TO
PROHIBIT THE INSTALLATION OR CONNECTION OF UTILITIES PRIOR TO THE
ISSUANCE OF A BUILDING PERMIT AS RE(~UIRED BY SECTION 391 OR A
CERTIFICATE OF OCCUPANCY AS REQUIRED BY SECTION 306; PROVIDING FOR
A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS
($200.00) FOR EACH OFFENSE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, Ordinance No. 120 of the City of The Colony adopted the Uniform
Building Code requiring building permits and certificates of occupancy under certain
conditions; and,
WHEREAS, the purpose of such Building Code requirements is to regulate for
the public health, safety and general welfare, the construction, alteration, use and
occupancy of buildings within the City; and,
WHEREAS, it is necessary in the enforcement thereof that it be made unlawful
for any public or private utility to instali or connect such utility prior to the issuance
of the requisite permits and certificate of occupancy; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY,
TEXAS:
SECTION 1.
That the Uniform Building Code, 1979 edition, of the International Conference
of Building Officials, heretofore adopted by reference by Ordinance No. 120 of the
City as the Building Code of the City, with the amendments therein specified, requires
in Section 301 that a building permit be secured under certain conditions and in Section
306 that a certificate of occupancy be secured under certain conditions.
SECTION 2.
That Section 205 of said Code be, and the same is hereby, amended to add the
following paragraph, to-wit:
"It shall be unlawful for any publie or private utility company operating
within the City of The Colony to furnish, connect, turn on, or otherwise provide
such utility service to any property owned by any person, firm, or corporation
which has commenced construction thereon in any manner set out in Section
301 of this Code without having first obtained a separate building permit from
the building official or to any person, firm, or corporation which attempts to
use or occupy an existing building or structure as set out in Section 306 of this
Code without having obtained a certificate of occupancy from the building
official as provided therein."
SECTION 3.
Any provision of the Uniform Building Code, 1979 edition, as amended by
Ordinance No. 120, in conflict with the provisions of this ordinance is hereby repealed.
SECTION 4.
Any person, firm, or corporation violating any of the provisions of this ordinance
or of the Uniform Building Code, 1979 edition, as amended hereby, shah be deemed
guilty of a misdemeanor and, upon conviction in the Municipal Court of the City of
The Colony, Texas, shah be subject to a fine not to exceed the sum of Two Hundred
Donars ($200.00) for each offense, and each such person shall be deemed guilty of a
separate offense for each and every day or portion thereof during which any violation
of any of the provisions of the Code, as amended, is committed, continued, or permitted.
SECTION 5.
This ordinance shah take effect immediately from and after its passage and the
publication of the caption as the ]aw and charter in such cases provide.
