AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, AMENDING
ORDINANCE NO. 15 OF THE CITY OF THE COLONY TO PERMIT THE CITY COUNCIL
TO ADOPT, BY RESOLUTION~ CERTAIN FEES FOR PARK AND RECREATIONAL
FACILITIES USES IN THE CITY; PROVIDING FOR A PENALTY OF FINE NOT TO
EXCEED THE SUM OF TWO HUNDRED DOLLARS FOR EACH OFFENSE; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council has determined that user fees should be adopted
for certain park and recreational facilities uses in the City; and,
WHEREAS, the City Council desires to provide that sueb fees can be adopted
and changed from time to time by resolution only; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY,
TEXAS:
SECTION 1.
That Section 1.04 of Ordinance 15 of the City of The Colony be, and the same
is hereby, amended by adding subsection (e) thereto~ which said subsection shall read
as fonows:
"Section 1.04 - Activities in Park Regulated: Promulgation and Posting of Rules~
Regulations
(e) The City Council shaH, from time to time, be authorized to adopt user
fees by resolution for certain park and recreational facilities uses within the
City. Such user fees shall be posted within the specific park or recreational
facility to which they apply in the same manner as the rules and regulations
authorized in subsection (b) above, and any person using any such park or
recreational facility without having first paid such user fees and baying secured
any necessary permit in connection therewith, shall be guilty of a misdemeanor
and subject to the penalties provided for in this ordinance."
SECTION 2.
Any person, firm, corporation, or association violating any provision of this
ordinance shall be deemed guilty of a misdemeanor, and shall upon conviction thereof,
be fined in any sum not less than One Dollar ($1.00) nor more than Two Hundred
Dollars ($200.00), and each day that the violation continues, and/or each act thereof,
shall constitute a separate offense.
SECTION 3.
This ordinance shall become effective from and after its passage and the
publication of the caption as the law and charter in such cases provide.
