HomeMy WebLinkAboutOrdinance No. 244 AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, AMENDING ORDINANCE NO. 168 TO REQUIRE THAT THE EXTERIOR WALLS, BELOW THE FIRST FLOOR PLATE LINE, OF RESIDENTIAL STRU.CTURES WITHIN THE CITY BE OF MASONRY OR SIMILAR MATERIAL; PROVIDING EXCEPTIONS; PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: SECTION 1. That Ordinance No. 168 of the City of The Colony be, and the same is hereby, amended to provide that no building permit shall be issued for the construction of any residential structure within the City unless the plans therefor provide for construction of not ]ess than 70% of the exterior walls thereof, below the first floor plate line, excluding doors and windows, to be of brick, brick veneer, stone, or other masonry or material of equal characteristics, except stucco. SECTION 2. Excepted herefrom are residential structures for which a building permit had been issued prior to the effective date of this ordinance. SECTION 3. Any person, firm or corporation violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and, upon conviction in the Municipal Court of the City of The Colony, Texas, shall be fined in an amount not to exceed the sum of Two Hundred Dollars ($200.00) for each offense, and each and every day any such violation shall continue shall be deemed to constitute a separate offense. SECTION 4. This ordinance shall take effect immediately from and after its passage and the publication of the caption as the law and charter in such cases provide.
