HomeMy WebLinkAboutOrdinance No. 255 ORDINANCE NO. ~--~ AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, AMENDING THE CODE OF ORDINANCES OF SAID CITY BY ADDING SECTIONS 11-6 THROUGH 11-9 TO CHAPTER 11, LIBRARY; PROVIDING THAT EVERY PERSON, PARENT OR GUARDIAN OF A CHILD WHO SHALL TAKE SUCH LIBRARY MATERIALS EXCEPT IN ACCORDANCE WITH THE RULES OF SUCH LIBRARY IS GUILTY OF A MISDEMEANOR; PROVIDING THAT IN THE CASE OF REFUSAL OR NEGLECT TO RETURN BORROWED MATERIALS AFTER NOTICE TO RETURN IS SENT TO THE ADDRESS OF THE BORROWER, SAID BORROWER IS GUILTY OF A MISDEMEANOR; PROVIDING THAT A PERSON MUTILATING, MARKING, TEARING OR OTHERWISE DEFACING OR DESTROYING OR INJURING IN PART OR WHOLE LIBRARY MATERIALS IS GUILTY OF A MISDEMEANOR; PROVIDING THAT THE PARENT OR GUARDIAN OF A CHILD UNDER SEVENTEEN (17) YEARS OF AGE WHO VIOLATES ANY PROVISIONS OF THE ORDINANCE IS SUBJECT TO THE PENALTIES OF THIS ORDINANCE; PROVIDING FOR CERTAIN FINES NOT TO EXCEED TWO HUNDRED DOLLARS ($200.00); PROVIDING A SEVERABILITY CLAUSE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: SECTION 1. That the Code of Ordinances of the City of The Colony, Texas, be and is hereby amended by adding Section 11-6 to Chapter 11, Library, as follows: "Section 11-6, Illegal Removal of Materials, Fine. That every person, parent or guardian of a child who is under the age of seventeen (17) years, who shall take or borrow from The Colony Public Library any book, pamphlet, periodical, paper or other property except in accordance with the rules of such Library, shall be deemed guilty of a misdemea- nor, and upon conviction thereof, shall be punished by a fine of not less than $5.00 nor more than $25.00 for each offense." SECTION 2. That the Code of Ordinances of the City of The Colony, Texas, be and is hereby amended by adding Section 11-7 to Chapter 11, Library, as follows: "Section 11-7, Return of Borrowed Materials, Fine. That every person, parent or guardian of a child under the age of seventeen (17) years who shall take or borrow from The Colony Public Library any book, pamphlet, periodical, paper or other property and neglect, refuse or fail to return the same within two weeks after the date of mailing a notice by certified mail with return receipt requested to his or her address noted on the current Library card shall be deemed guilty of a misdemeanor and, on conviction thereof, shall be punished by a fine not to exceed Two Hundred Dollars ($200.00) for each offense, plus all fines normallyk~ssessed by the Library for each day's violation obits rules." SECTION 3. That the Code of Ordinances of th~ City of The Colony, Texas, be and is hereby amended by addihg Section 11-8 to Chapter 11, Library, as follows: "Section 11-8, Defacing of Library Materials, Fine. That every person, parent or guardian of a child under the age of seventeen (17) years who shall willfully or wantonly cut, mutilate, mark, tear, write upon, deface or otherwise destroy or injure in whole or in part, any book, pamphlet, periodical, map or document, picture, or written or engraved or printed paper or any other Library property belonging to the City of The Colony Public Library, or shall suffer any such injury to be inflicted while such property is in his custody, or shall willfully or wantonly injure any of the furniture or property in the building of The Colony Public Library, or shall willfully or wantonly mark or deface or in any way injure The Colony Public Library or any part thereof, or any fixtures therein or appurtenances thereto, shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be punished by a fine of not less than $5.00 nor more than $200.00 for each offense." SECTION 4. That the Code of Ordinances of the City of The Colony, Texas, be and is hereby amended by adding Section 11-9 to Chapter 11, Library, as follows: "Section 11-9, Penalties. That any person, parent or guardian of a child under the age of seventeen (17) years who violates any of the provisions of this ordinance shall be subject to the penalties as provided for herein, and where the amount of the penalty is not specifically provided for herein, any person guilty of violating any of the provisions of this ordinance shall be subject to a fine not to exceed the sum of Two Hundred Dollars ($200.00) for each offense." SECTION 5. That should any word, phrase, sentence, paragraph, section or portion of this ordinance be held to be void and unenforceable, the remaining provisions of said ordinance shall remain in full force and effect. SECTION 6. This ordinance shall take effect immediatey from and after its passage by the City Council and the publication of the caption as the law and charter in such cases provide.
