HomeMy WebLinkAboutOrdinance No. 84ORDINANCE NO. 84 AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, ANNEXING THE HERINAFTER DESCRIBED TERRITORY TO THE CITY OF THE COLONY. DENTON CONTY, TEXAS, AND EXTENDING THE BOUNDARY LIMITS OF SAID CITY SO AS TO INCLUDE SAID PROPERTY WITHIN SAID CITY LIMITS AND GRANTING ALL PRIVILEGES OF OTHER CITIZENS AND BINDING ALL INHABITANTS BY ALL THE ACTS, ORDINANCE AND REGULATIONS OF SAID CITY: PROVIDNG FOR THE EXTENSION OF THE EXTRATERRITORIAL JURISDICTION OF THE CITY; PROVIDING SEVERABILITY: AND PROVIDING FOR AN EFFECTIVE DATE OF SAID ORDINANCE. WHEREAS, the City of The Colony Staff has heretofore proposed the annexation of all the property hereinafter described, requesting the City Council to annex said territories and extend the corporate limits of said City; and, WHEREAS, after holding public hearing under the provisions of Article 970a of the Revised Civil Statutes of Texas; and, WHEREAS, the following described land is adjoining the present City Limits of the City of The Colony, and the members of the City Council of the City of The Colony have concluded that said area should be annexed and made a part of the City of The Colony, Texas: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: SECTION 1. That the following described territory be, and the same is hereby annexed to the City of The Colony, Denton, County, Texas, and the boundary limits of the City of The Colony be, and the same are hereby extended to include the following described territory within the City Limits of the City of The Colony, and the same hereafter shall be included within the territorial limits of said City, and the inhabitants therefore hereafter shall be entitled to all rights and privileges of other citizens of the City of The Colony; and shall be bound by the acts, ordinances, resolutions and regulations of said City. That the territory to be so annexed is more particularly described as follows, to -wit: All that certain lot, tract, or parcel of land, lying in the County of Denton, State of Texas, and being a part of a certain First Tract of 156.5 acre tract of land as N conveyed by deed dated September 7, 1950, from John A Griffin and wife, Jennie Griffin, to John A. Griffin, Jr. and wife, Dorothy Griffin_, Trustee, as shown of record in Volume 375, page 256, of the Deed Records of Denton County, Texas; being out of the ]BBB & CRR Co. Survey, A-172, and being more particularly described as follows: BEGINNING at a steel pin in the North boundary line of an East and West public road whose width is 40 feet, and being North, 20 feet from, and South, 89 degrees, 10 min. East, 295.19 feet from, the Southwest corner of the past mentioned John A. Griffin, Jr. 156.5 acre tract; same being the Southeast corner of a two acre tract, now in the name of J.Y. Eberhart and wife, Vera Eberhart; THENCE North, 295.19 feet to a steel pin for the Northeast corner of the above mentioned Eberhart two acre tract; THENCE South 89 degrees, 10 min. East, 76.4 feet, to a steel pin for corner; THENCE South 01 degree, 02 min., 54 seconds West, 295.16 feet, to a steel pin for corner in North boundary line of an East and West public road whose width is 40 feet; THENCE North 89 degrees, 10 min. West, 71.00 feet, to point of beginning, and containing .499 of an acre of land. SECTION 2. That it is not the intention of the City of The Colony to annex any territory not legally subject to being annexed by said City, and should any portion of the above des- cribed territory not be subject to legal annexation by the City of The Colony, such fact will not prevent the City from annexing such territory which is above described and is subject to legal annexations by the City, and it is the intention of the City of The Colony to annex only such territory as may be legally annexed by it within the limits of the above described area. SECTION 3. That this ordinance shall take effect immedia- tely from and after its passage and the publication of the caption as the law and charter in such cases provide.
