AN ORDINANCE OF THE CITY OF THL COLONY, TEXAS, ESTABLISHING
A ~;~XIMUM LAWFUL PRI~ FACIE SPEED LIMIT OF FIFTY-FIVE (55) MILES
PER HOUR ON PORTIONS OF STATE HIGHWAY 121 WITHIN THE CORPORATE CITY
LIMITS OF THE CITY OF THE COLONY AND OF FORTY-FI~E (45) MILES PER
HOUR ON PORTIONS OF STATE HIGHWAY 121 WITHIN ThE CORPORATE CITY
LIMITS OF THE CITY[ P~EPEALING ORDINANCE 89; PROVIDING A PENALTY
OF FINE NOT TO EXCEED THL SUM OF TWO HUNDRED DOLLARS ($200.00)

WHEREAS, the Governing body of the City of The Colony, Texas,
has determined, upon the basis of an engineering and traffic in-
vestigation, that certain portions of State Highway 121 within the
City Limits of the City of The Colony should be aitere~ to maximum
of forty-five (45) miles per hour because such investigation shows
that such speed is reasonable and safe under the conditions existing,
NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY,
TEXAS:
SECTION 1. Upon the basis of an engineering and traffic investi-
gation, a maximum lawful prima facie speed limit of forty-five (45)
miles per hour for motor vehicles is hereby established upon the fol-
lowing named highway to the extent described, to-wit:
On State Highway 121 beginning at a point 2.209 miles
southwesterly from the northeast City Limits line
(Station 582 + 73) and continuing in a southwesterly
direction for a distance of 0.206 miles, approximately,
said point (Station 455 + 20) being the southwesterly
City Limits of the City of The Colony.
SECTION 2. That the remaining portions of State Highway 121,
beginning at Station 582 + 73, the northeast City Limits line, thence
southwesterly for a distance of 2.209 miles shall retain its present
lawful prima facie speed limit of fifty-five (55) miles per hour.
SECTION 3. It shall be unlawful and an offense for any person
to drive or operate any motor vehicle along and upon such portions
of State Highway 121 within the corporate limits of the City in
excess of such maximum lawful prima facie speed limits, and any
evidence of any speed in excess of such limits shall be prima facie
evidence that such speed is not reasonable or prudent under the
circumstances then existing and is unlawful.
SECTION 4. The City Manager or his designated representative
is hereby authorized to cause appropriate signs indicating such
speed zones to be erected giving motorists notice of such speed
limits.
SECTION 5. Ordinance N~,ber 89 is hereby repealed.
SECTION 6. Any person violating any of the provisions of this
ordinance shall be deemed guilty of a misdemeanor and upon con-
viction in the Municipal Court of the City of The Colony, Texas,
shall be fined in an amount not to exceed the sum of Two Hundred
($200.00) Dollars for each offense.
SECTION 7. This ordinance shall become effective from and after
its passage and the publication of the caption as the law and
charter in such cases provide, but the speed limits established
hereby shall not be effective unless and until appropriate signs
are erected on such highway giving motorists notice thereof.
