AN ORDINANCE OF THE CITY OF ThE COLONY, TEXAS, AUTHORIZING
THE CITY MANAGER TO ACCEPT DEEDS AND MAKE PAYMENT FOR TWO TRACTS
OF LAND AS HEREAFTER DESCRIBED; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, FOX & JACOBS, INC., has offered to sell to the City
of The Colony, Texas, a park site and a fire station site at its
cost, and
WHEREAS, the City Council has determined that the acquisition
of such sites is necessary in the interest of the public health,
safety and general welfare, and
WHEREAS, the City Council is required by the City Charter to
authorize the expenditure of funds for the acquisition of such
sites, NOW, Ti~EREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY,
TEXAS:
SECTION 1. That the City Manager of the City of The Colony,
Texas, is hereby authorized to accept, on behalf of the City of
The Colony, a general warranty deed to the fire station site de-
scribed herein on Exhibit "A" which is made a part hereof for all
purposes. That he is further authorized to accept a general warranty
deed to the park site described herein on Exhibit "B" and made a
part hereof for all purposes.
SECTION 2. That in consideration of the general warranty deed
from FOX & JACOBS, INC., the City Manager is authorized to pay to
FOX & JACOBS, INC., the sum of Thirteen Thousand Nine Hundred and
Ninety-Four Dollars ($13,994.00) for the property described in Ex-
hibit "A" and the sum of Thirty Four Thousand Eight hundred and
Eighty-Two ($34,882.00) for the property described in Exhibit "B".
SECTION 3. That such deed shall have the standard language of
a general warranty deed as is the usual custom and practice of
real estate transactions in the State of Texas. That such deeds
shall be properly acknowledged by the duly authorized officer of
FOX & JACOBS, INC., and shall be in due form to be recorded in the
Deed Records of Denton County, Texas.
SECTION 4. This ordinance shall take effect immediately from
and after its passage and the publication of the caption as the
law and charter in such cases provide.
