POSE, ORGANIZATION, APPOINTMENT AND DUTIES OF THE COLONY PUBLIC LIBRARY BOARD; ESTABLISHING THE POSITION AND DUTIES OF THE COLONY LIBRARIAN; PPOVIDINO FOR THE OPERATION OF THE COLONY PUBLIC LIBRARY; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITV COUNCIL OF THE CITY OF THE COLONY TETRAS: SECTION l. There is hereby created a Colony Public Library Board. The Board shall serve as an advisory Board to the City Cotmcil of the City of The C'o!ony and shall, under the authority of the City Council, be involved with the Librarian in Do]icy making relating to the establishment and usage of the Colony Public Librarv or Libraries, the natl~re of services rendered or to be rendered by the Library or Libraries, the manner in which the Library service may be coordinated with the services of othe~ Libraries which render services to citizens of the City, and in s~lcb other matters as the City Council may direct. SECTION 2. The Library Board shall consist of five (5) members who shall be residents, qualified voters and taxpayers of the City of The Colony. The Board shall select from among its members a Chairman and a Vice Chairman. The Librarian shall serve as Secretary and Ex Officio Member of the Library Board. Members of the Library Board sba]] be appointed by the Mayor with the aDProva] of the City (~ounci]. The Mayor shall also serve as an Ex Officio ~6ember of the Board. A~I members and Ex Officio Members of the Board shall serve for two (2) year terms. Of the first five appointments to the Board, th,ce shall be for a term of two (2) years, and two shall be for one (1) year; thereafter, three members shal! be appointed during even numbered years and two members sha]] be appointed during odd n]~mbered years. Vacancies shall be filled by appointment by the Mayor with approval of the ('ltv Counci! for the remaining portion of the unexpired term of the vaeant position being filled. The members of the Board shah be subject to removal from office by the City Council for any cause deemed sufficient by the r!oune~ for their removal SECTION 3. The duties of the Librarv Board shall he as fol]nws: (A) Hold monthly meetings at regular stated times, such meetings to be open to the pub]in and subiect to the provisions of the Texas Open Meetings Law; (B) To receive suggestions and recommendations respecting' the de- velopment of the Library and Library service and to make recom- mendations to the City Council re,~'ardin~' the same as are deemed necessary and desirable in the opinion of the Boa.a: (C) To make periodic reports to the City Council concerning' the work of the Library Board and make any such specml reports as may be requested by the City Council; (D) To carry out and perform sueb other reasonable re~lflations and requirements as may from time to time be made and adopted bv the City Council. SECTION 4. The Librarian shall be appointed by the City l~anager of the City of The Colony and shah serve as administrative head of the C'olonv Pl{b]ie Library. The Librarian shall supervise the maintenance and use of the Library and shall maintain an appropriate set of books or other suitable records in which shall be kept all receipts and expenditures of the Library and a complete listing of all books, oeriod{ea]s, manuscripts, furniture, furnishings, ~nstruments, apparatus or other property or eouip,- ment purchased for or donated to the Librarv. The Librarian shall have authorit~v to maintain order in and about the Library premises. The IJbrarian shall prepare An annual report to the Library Board and the City Council and shall submit Al} such reports as may be required or rec{uested by the Board, the C~{tv Counci] nr other State, National or Local Agency. The Librarian shall prepare a Budget to be submitted to the Board for approval and transmittal to the City l~anager for inclusion in the Annual Budget of the City. SECTION 5. The general rules and and regulations for the operation and use of the Library shall be promulgated by the Librarian and approved by the City {~ana~'er. The books, newspapers, magazines, pamphlets, manuscripts, or other property of the Colony Public Library shall be the property of the City of The Colony and any person inj~lring or defacing any such property shall be liable to account therefor to the Librarian. The Librarian sha{] have authority to establish fines for any person retainin~ any such book, newspaper, magazine, pamphlet, manuscript or other property beyond the expiration of the time which by the rules of the Library s~,cb propertv may be kept. SECTION 6. This ordinance shall take effect immediately, from and after its passage on second and final reading and the ptlblieatio~ of the caption as the ]a~ ~od charter in such cases provide.
