HomeMy WebLinkAboutOrdinance No. 423 CITY OF THE COLONY ORDINANCE NO. ~ AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, AMENDING CHAPTER 11 OF THE CODE OF ORDINANCES, CITY OF THE COLONY, BY AMENDING SECTION 11-2 RELATING TO MEMBERSHIP AND OFFICERS OF THE LIBRARY BOARD; PROVIDING A SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE DATE AND DECLARING AN EMERGENCY. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: SECTION 1. That Section 11-2 of Chapter 11 of the Code of Ordinances, City of The Colony, Texas, relating to membership and officers of the Library Board is hereby amended to add two (2) alternates to the Library Board by amending Section 11-2 in the following particulars, and all other existing sections, subsections, paragraphs, sentences, definitions, phrases and words of said Code of Ordinances are not amended but, shall remain intact and are hereby ratified, verified and affirmed. A. That Section 1 1-2 is amended to read as follows: "The Library Board shall consist of five (5) members and two (2) alternates who shall be residents, qualified voters and taxpayers of the City of The Colony· The Board shall select from among its members a Chairman and a Vice Chairman. The Librarian shall serve as Secretary and Ex Officio Member of the Library Board. Members and alternates of the Library Board shall be appointed by the Mayor with the approval of the City Council· The Mayor shall also serve as an Ex Officio Member of the Board· All members, alternates, and Ex Officio Members of the Board shall serve for two (2) year terms· Of the first five (5) appointments to the Board, three (3)shall be for a term of two (2) years, and two shall be for one (1) year; thereafter, three (3) members and one (1) alternate shall be appointed during even numbered years and two (2) members and (1) alternate shall be appointed during odd numbered years· Vacancies shall be filled by appointment by the Mayor with approval of the City Council for the remaining portion of the unexpired term of the vacant position being filled. The members of the Board shall be subject to removal from office by the City Council for any cause deemed sufficient by the Council for their removal.' SECTION 2. If any section, article, paragraph, sentence, clause, phrase or word in this Ordinance or appiication thereto, or any person or circumstance is held invalid or unconstitutional by a Court of competent jurisdiction such holding shall not affect the validity of the remaining portions of the ordinance; and the City Council hereby declares it would have passed such remaining portions of the Ordinance despite such invalidity, which remaining portions shall remain in full force and effect. SECTION 3. The fact that the present Ordinances and regulations of the City of The Colony, Texas, are inadequate to properly safeguard the health, safety, morals, peace, and general welfare of the inhabitants of the City of The Colony, Texas, creates an emergency for the immediate preservation of the public which requires that this Ordinance shall become effective from and after the date of its passage and it is accordingly so ordained.
