AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS AMENDING THE CODE OF ORDINANCES OF THE CITY BY AMENDING ARTICLE II OF CHAPTER 6 OF THE CODE RELATING TO SIGNS; AMENDING THE DEFINITIONS RELATING TO SPECIAL PURPOSE SIGNS AND VEHICULAR SIGNS; AMENDING THE REGULATIONS RELATING TO GOVERNMENT AND VEHICULAR SIGNS; AMENDING THE REGULATIONS RELATING TO SIGN AND THE MAXIMUM LETTERgLOGO HEIGHT; ADDING STANDARDS CONCERNING THE DISPLAY OF COMPANY SIGNS; PROVIDING A SEVERABILITY CLAUSE; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL OTHER ORDINANCES OF THE CITY RELATING TO SIGNS EXCEPT TO THE EXTENT OF CONFLICT HEREWITH; PROVIDING A PENALTY NOT TO EXCEED THE SUM OF ONE THOUSAND DOLLARS ($1,000.00) AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED EACH DAY DURING OR ON WHICH A VIOLATION OCCURS OR CONTINUES; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: Section 1. That Chapter 6 of the Code of Ordinances of the City of The Colony, Texas (the "City") relating to Buildings, Construction and Related Activities is hereby amended by amending Article II thereof relatLng to signs in the following particulars, and that all other chapters, sections, subsections, paragraphs, sentences, words and phrases of said Code are not amended but are hereby ratified, verified, approved and affirmed: A. That Section 6-21 of Article H relating to definitions is amended to read as follows: "See. 6-21. Definitions. For the purposes of this article, the following words and phrases shall have the meanings respectively ascribed to them by this section: (14) Sign, Speeiai Purpose - a sign no more than 3 square feet in area temporarily supplementing the permanent signs on the premises. (15) Sign, Vehicular - any sign on or in a vehicle moving along the ground or on any vehicle parked temporarily, incidental to its prineipai use for transportation. This definition shall not include signs which are being transported to a site of permanent erection or lettering on company vehicles that advertises only the company name, address and phone number." B. That Section 6-22 of Article II relating to provisions for all zoning districts is amended to read as follows: "See. 6-22 Provisions for all zoning districts. The following provisions shall apply to all zoning districts: (1) Government signs. Nothing in this article shall be construed to prevent the display of a national ting or state flag, or to Hmit flags, insignia, legal notices, or informational, directional, or traffic signs which are legMly required or necessary to the essential functions of government agencies, or any approved promotional banners or decorations related to civic, philanthropic, or municipal events. Approved national, state, and city flags shall be no greater than 35 square feet in area and placed no higher than 30 feet above ground level. (14) Vehicnlar signs. Vehicular signs are specifically prohibited. However, vehicular signs shall be allowed on construction trailers that have temporary permits, on construction sites and signs on transport vehicles being loaded or unloaded and passenger or service vehicles parked at the owner's or user's place of residence, location where service is being provided, or permanent place of business as long as the vehicle's location does not constitute supplemental on-site advertising as determined by the Building Official." C. That Section 6-24 of Article II relating to business districts is amended to read as follows: "Sec. 6-24. Business districts. The following provisions shall apply in the business districts: (9) Same-Area. The total effective area of attached signs shall not exceed the following schedule: d. Maximum lettar/logn height of attached signs shall be determined by the following schedule, the sign height being measured from the base of the sign to the ground: Sign Height Maximum Letter/Logo Height Between 0-36 feet 36 inches Between 37-48 feet 48 inches Between 49-100 feet 60 inches Between 100 feet and up 72 inches (~) The above table represents the maximum letter and/or logo height in each individual sign height category. Where the sign is totally composed of individually mounted letters, either one (1) letter or logo may be twenty-five percent (25%) tallar than the specified maximum letter/logo height. (10) Companies shall be al/owed to display a company flag in compliance with provisions set out in Section 6.22-1 regarding governmental signs, only when displayed with a United States flag and/or a Texas State flag." Section 2. If any section, article, paragraph, sentence, clause, phrase or word in this ordinance, or application thereto any person or circumstance is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance; and the City Council 0042J --2-- hereh~ deel~es it wo~ld have passed such remaining portions of the o~linanee despite sue~ imralidity, which remaining portions shall remain in full force and effect. Section 3. That this ordinance shall be cumulative of all other ordinances of the City affecting signs and shall not repeal any of the provisions of said ordinances except in those instances where provisions of those o~dinanees are in direct conflict with the provisions of this ordinance. Section 4. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be subject to a fine in a sum not to exceed One Thousand Dollars ($1,000.00) for eanh offense and a separate offense shall be deemed committed upon eanh day during or on which a violation occurs. Section 5. That fart that the present ordinances and regulations of the City of The Colony, Texas, ace inadequate to properly safeguard the health, safety, morals, peane, and general weffare of the inhabitants of the City of The Colony, Texas, creates an emergency for the immediate preservation of the public business, property, health, safety, and general weffare of the public which requires that this ordinance become effective from and after the date of its passage and it is aneordingly so o~lalned.
