HomeMy WebLinkAboutOrdinance No. 443 ORDINANCE NO. 443 AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS, CANVASSING RETURNS AND DECLARING THE RESULTS OF A BOND ELECTION HELD IN THE CITY ON THE 13TH DAY OF SEPTEMBER, 1986; DECLARING AN EMERGENCY THE STATE OF TEXAS § COUNTY OF DENTON § CITY OF THE COLONY § WHEREAS, this governing body, by ordinance duly passed and adopted, made provision for an election to be held within the City on the 13th day of September, 1986, for the purpose of submitting certain propositions for the issuance of general obligation bonds to the resident, qualified electors of said City; WHEREAS, this City Council has investigated all matters pertaining to the election, including the ordering, giving notice, appointing officers, holding and making returns of the election; and the election officers who held the election have duly made the returns of the results thereof, and the returns have been duly delivered to this City Council for official canvassing of the returns thereof; and WHEREAS, upon consideration of the returns of the election, it appears that the election was held in accordance with the authorized proceedings and was in all respects legully held after proper notice had been given, and that the the returns were duly and legally made, showing the following results: PROPOSITION NO. 1 THE ISSUANCE OF $500,000 GENEi{AL VOTES FOR 315 OBLIGATION PUBLIC PARK BONDS, INCLUDING BUT NOT LIMITED TO IMPROVEMENTS OF STEWART CREEK PARK, AND THE LEVY OF A TAX IN PAYMENT THEREOF VOTES AGAINST 360 PROPOSITION NO. 2 THE ISSUANCE OF $2,500,000 GENERAL VOTES FOR 274 OBLIGATION PUBLIC PARK BONDS, INCLUDING BUT NOT LIMITED TO THE ACQUISITION AND CONSTt{UCTION OF A PUBLIC GOLF COURSE AT WYNNEWOOD PARK, AND THE LEVY OF A TAX IN PAYMENT THEREOF VOTES AGAINST 396 THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY: 1. All of the recitals contained in the preambles of this Ordinance are found to be true and are adopted as findings of fact by this governing body and as part of its judgment. 0593D 2. It is further found and determined that the results of the election as canvassed and tabulated in the preambles hereof reflect the expressed desires of the resident, qualified electors of the City. 3. Based upon the results of the election, the City Council officially finds, determines and declares the result of said election to be that Proposition No. 1 and Proposition No. 2 both failed to pass and therefore no bonds may be issued thereunder. 4. As a result of this canvass, the City Council hereby finds and determines that a totai of 675 persons voted in the City of The Colony, Texas, Bond Election held on September 13, 1986. 5. That the public importance of this measure and the fact that it is to the best interest of the City and its citizens to canvass the results of the election on propositions to provide funds for public parks for said City at the earliest possible date for the immediate preservation of the public health, safety, general welfare, or public property of the City and its citizens creates an emergency and an imperative public necessity, requiring that this Ordinance be passed as an emergency measure which shall be effective and be in full force from and after its passage, and it is so ordained. ATTEST: City Secretary, City of The Colony, Texas [SEAL] APPROVED: City Attorney, City of The Colony, Texas 0593D --2-- MINUTES AND CERTIFICATION PERTAINING TO PASSAGE OF AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS, CANVASSING RETURNS AND DECLARING THE RESULTS OF A BOND ELECTION HELD IN THE CITY ON THE 13TH DAY OF SEPTEMBER, 1986; DECLARING AN EMERGENCY THE STATE OF TEXAS § COUNTY OF DENTON § CITY OF THE COLONY § On this the 15th day of Septebmer, 1986, the City Council of the City of The Colony, Texas, convened in Regular Meeting at the regular meeting place thereof, the meeting being open to the public and notice of said meeting, giving the date, place and subject thereof having been posted as prescribed by Article 6252-17 Tex. Rev. Civ. Stat. Ann., and the roll was called of the duly constituted officers and members of said City Council, which officers and members are as follows to-wit: Larry D. Sample, Mayor Rick Harris ) Patti A. Hicks, City Secretary Tom Arrambide ) David W. Dye, III ) Don Amick ) Councilmembers Harvey Bradley ) Marlene Poole ) and all of said l~.rsons were present, except the following absentees: -~ C) r4 Ar~ ~¢J~ ~- ~P~P~t-r~r~E ~o~£ ' thus constituting a quorum. Whereupon, among other business, the following was transacted at said meeting: A written Ordinance bearing the following caption was introduced: "An Ordinance of the City Council of the City of The Colony, Texas, Canvassing Returns and Declaring the Results of a Bond Election held in the City on the 13th day of September, 1986; Declaring an Emergency" The Ordinance, a full, true and correct copy of which is attached hereto was read and reviewed by the City Council. Thereupon, it was moved __by Councilmember -~V ~ ~ ~h/.~y~,-f-/-F and seconded by Couneilmember ~ I C_~._ ~~1 5 that the Ordinance be passed and adopted.
