AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, AMENDING
APPENDIX A OF THE CODE OF ORDINANCES OF THE CITY OF THE COLONY
RELATING TO ZONING BY THE AMENDMENT OF CERTAIN SECTIONS
THEREOF; ADDING A MULTIPLE-FAMILY-3 AND MULTIPLE-FAMILY-4 ZONING
DISTRICT; RELATING TO THE ESTABLISHMENT AND PURPOSE OF ZONING
DISTRICTS; RELATING TO THE USE OF LAND AND BUILDINGS; RELATING TO
LOT AREA REQUIREMENTS; RELATING TO LOT WIDTH REQUIREMENTS;
RELATING TO DWELLING AREA REQUIREMENTS; RELATING TO FRONT YARD
REQUIREMENTS; RELATING TO SIDE YARD REQUIREMENTS; RELATING TO
HEIGHT REGULATIONS; RELATING TO VEHICLE PARKING REGULATIONS;
PROVIDING A SAVINGS CLAUSE: PROVIDING FOR SEVERABILITY; PROVIDING A
PENALTY NOT TO EXCEED ONE THOUSAND DOLLARS ($1,000.00) AND A
SEPARATE OFFENSE SHALL BE DEEMED COMMITED EACH DAY DURING OR
ON WHICH A VIOLATION OCCURS OR CONTINUES; PROVIDING AN EFFECTIVE
DATE AND DECLARING AN EMERGENCY
WHEREAS, the Planning & Zoning Commission of the City and the City
Council, in compliance with the laws of the State of Texas and with the provisions
of the Comprehensive Zoning Ordinance of the City, have given the requisite notices
by publication and otherwise and have held due hearings and afforded a fu/1 and fair
hearing to all property owners and citizens of the City and
NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF THE COLONY, TEXAS:
Section 1. Appendix A, Section 1-100 of the Code of the City of The Colony
is hereby amended to read as follows:
"1-100. The following comprehensive general zoning ordinance of the City of
The Colony, together with a map creating and delineating twenty (20) zoning
districts, which map defines the boundaries of each Use District, shall read as
follows."
Section 2. Appendix A, Section 3-100 is hereby amended
to read as follows:
"3-100. The City of The Colony, Denton County, Texas is hereby divided into
twenty (20) zoning districts which are further subdivided into subdistriets where
appropriate. The use, height, area, and parking regulations as set out herein are
uniform in each district. The twenty (20) districts herein established shah be known
and cited as:

of section 10-1100 (Flood Plain).

provisions of sections 10-1900 through 10-1902 (Historic)."
Section 3. Appendix A, Section 4-104 is hereby amended to read as follows:
"(4-104) MF-1, MF-2, MF-3 and MF-4, Multiple Family Dwelling districts:
These districts are composed of areas containing multiple-family dwellings and
certain uniformly developed multiple-family dwelling sections. The MF-1, MF- 2,
MF-3 and MF-4 districts are medium density districts and are located in certain
areas close to the center of the city at various outlying locations. The area
regulations are designed to protect the residential character and prevent the
overcrowding of the land in the MF-1, MF-2, MF-3 and MF- 4 districts by providing
minimum standards for building spacing, yards, off-street parking and coverage.
Except for the provisions concerning density, height restrictions and dwelling area,
which shall be controlled by the provisions contained in the PD district, the MF-4
elasslfications shall be similar to those applicable to the MF-1, MF-2 and MF-3
districts. All commercial and office uses are prohibited in the MF-1, MF-2, MF-3
and MF-4 districts. It is anticipated that additional areas may be designated in the
MF-1, MF-2, MF-3 and MF-4 districts from time to time in the future where such
change is appropriate and access and utility services can reasonably accommodate
such medium density dwellings."
Section 4. Appendix A, Section 10-200 is amended to read as provided in
Exhibit "A", attached hereto and incorporated herein for all purposes.
Section 5. Appendix A, Section 10-301, is amended to read as follows:
"(4) Maltiple family: Three (3) or more dwelling units each
occupied by not more than one (1) family. All living uuits shall be separated
from all other portions of the building by one (1) hour rated fire wails,
Including attic space, within the vertical plane of any unit's party walls and
that all exterior walls be one (1) hour fire rated. Five percent (5%) of the
square footage in each dwelling unit must be storage area. Fifty (50) square
feet per unit must be provided on site for dead storage. Parking of boats,
recreational vehicles and trailers shall be prohibited in the parking lots of
said units. All principal buildings and structures shall be of exterior fire
resistant construction, having at least forth percent (40%) of the total
exterior walls below the highest plate line, excluding doors and windows,
constructed of brick, stone or other masonry or material of equal
characteristics in accordance with the city's building code and fire
prevention code.'
Section 6. Appendix A, Section 11-100, is amended to read as follows:

Section 8. Appendix A, Section 11-301 of the Code of the City of The Colony
is hereby amended to read as follows:
"District Minimum Floor Area Per Dwelling Unit. (Single family
residence only)
SF 1,100 sq. ft. (Single family and two family residences).
D Duplex - TotaJ both units - 1,800 sq. ft. divided into two (2)
units of not less than 900 sq. ft. each.
TH 1,100 sq. ft.
MF-1 Average of ail units in building or project must be 800 sq. ft.
minimum with a minimum per unit of 600 sq. ft. Maximum
density is 10 units per acre pins 50% bonus to 15 units per
acre.
MF-2 Average of all units in building or project must be 800 sq. ft.
minimum with a minimum per unit of 600 sq. ft. Maximum
density is 12 units per acre plus 50% bonus to 18 units per
MF-3 Average of all units in building or projeet must be 800 sq. ft.
minimum with a minimum per unit of 600 sq. ft. Maximum
density is 16 units per acre pins 50% bonus to 24 units per

Section 9. Appendix A, Section 11-400 is hereby amended to read as follows:
"11-400. Front Yard. In the following zoning districts the minimum required
front yard shall be in accordance with the following schedule and no building,
structure or use shall hereinafter be located, erected or altered so as to have a
smaller front yard than hereinafter required and no front yard existing at the time
of passage of the ordinance shall be reduced below the minimum set forth in the
following schedule:

Section 10. Appendix A, Section 11-402 is hereby amended to include a new
subsection (12) which shall read us follows:
"11-402(12) In the MF-1, MF-2, MF-3 and MF-4 districts, if more than 2
stories are proposed, and if the buildings are adjacent to a SF, D, TH, MF-1, MF-2,
MF-3 or MF-4 district where there are structures less than three (3) stories high, an
additional twenty-five (25) feet are required plus two times (2X) the height of the
portion of the building above two (2) stories, to be measured from the property line.
This shall not apply if all buildings in an adjacent MF-4 district exceed three (3)
stories."
Section 11. Appendix A, Section 11-500 is hereby amended to read as follows:
"11-500 Side Yard. In the following zoning districts the minimum required
side yard shall be in accordance with the following schedule and no building,
structure or use shall hereafter be located so as to have a smaller side yard on
either side yard on either side of such building than herein required.
(1) The minimum required side yard for single family and two family uses
may be varied but in no ease shall a side yard be less than the minimum
dimensions indicated as follows:

districts shall provide a mihimum side yard of twenty-five (25) feet on either
side of the main building."
Section 12. Appendix A, Section 11-601(1) is hereby amended to read as
follows:
"11-601(1) In the A, SF, MF-i, MF-2, MF-3, MF-4, MH and P districts, no
main residential building may be constructed nearer than ten (10) feet to the rear
property line. The main residential building and all aneesso~y buildings shall not
cover more than fifty percent (50%) of that portion of the lot lying to the rear of a
line erected ] mung the mid-point on one side left line with the mid-point of the
opposite side lot line. For aneessory building standards see 11-702 (See Appendix
Illustration 3)."
Section 13. Appendix A, Section 12-101 is hereby amended to read as follows:

Section 14. Appendix A, Section 12-102 is hereby amended to read as follows:
"(12-102) Special height restrictions. In the districts where the
height of the buildings is restricted to two (2), two and one-half (2 1/2) or
three (3) stories, cooling towers, roof gables, chimneys and vent stacks may
extend for an additional height not to exceed forty-five (45) feet above the
average grade line of the building. Water stand pipes and tanks, church
steeples, domes and spires and school buildings and institutional buildings may
be erected to exceed two (2) stories in height, provided that one (1) additional
foot shall be added to the width and depth of side and rear yards for each
foot that such structures exceed two (2) stories in height."
Section 15. Appendix A, Section 13-101 is hereby amended to read as follows:
"In the following zoning districts the mInimum off-street parking spaces for
residential uses shall be:
(1) A, Agricultural Two (2) spaces for each dwelling

(2) SF, Single Family Two (2) spaces for each dwelling

Section 16. Appendix A, Section 13-103 (2) and (3) are hereby amended to
read as follows:
"13-103 Special off-street parking regulations
(2) In the SF, D, TH, MF-1, MF-2, MF-3, MF-4, MH, 0-1, 0-2 or NS
districts, no parking space, garage or carport or other automobile storage space or
structure shall be used for the storage of any truck or trailer except a panel or
pickup truck not exceeding one (1) ton capacity.
(3) In the SF, D, TH, MF-1, MF-2, MF-3, MF-4 districts, a boat or
recreational vehicle Including a motor home or travel trailer may be parked or
stored on the residential premises of the owner provided that such boat vehicle or
motor home may be parked or stored only within that portion of the residential lot
which is located to the rear of the required front yard line."
Section 17. That the zoning regulations as herein established have been made
for the purpose of promotIng the health, safety, morals and the general welfare of
the community.
Section 18. That this Ordinance shall be cumulative of all other Ordinances
of the City affectIng zoning and shall not repeal any of the provisions of said
Ordinances except In those instances where provisions of those Ordinances are In
direct conflict with the provisions of this Ordinance.
Section 19. If any section, article, paragraph, sentence, clause, phrase or
word in this Ordinance, or application thereof to any person or circumstance, is held
invalid or unconstitutional by a Court of competent jurisdiction, such halding shall
not affect the validity of the remaining portions of the Ordinance, and the City
Council hereby declares it would have passed such remaining of the Ordinance
despite such invalidity, which remaining portions shall remain in full force and
effect.
Section 20. Any person violating any of the provisions of this Ordinance shall
be deemed guilty of a misdemeanor and upon conviction thereof, shall be fined in a
stun not to exceed One Thousand Dollars ($1,000.00) for each offense and a separate
offense shall be deemed committed upon each day during or on which a violation
occurs or continues.
Section 21. The fact that the present zoning ordinance and regulations of the
City are inadequate to properly safeguard the health, safety, morals, peace and
general welfare of the inhabitants of the City creates an emergency for the
immediate preservation of the public business, property, health, safety and general
welfare of the public which requires that this Ordinance shall become effective
from and after the date of its final passage and publication as provided by law, and
it is accordingly so ordained.
