AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS
AMENDING APPENDIX A-ZONING OF THE CODE OF ORDI-
NANCES BY AMENDING SECTION 11-300 RELATING TO THE
MINIMUM ENCLOSED DWELLING AREA FOR A DWELLING UNIT;
PROVIDING FOR AN INCREASE IN THE MINIMUM DWELLING
AREA FOR A SINGLE FAMILY RESIDENCE FROM 1,100 SQUARE
FEET TO 1,300 SQUARE FEET; PROVIDING A SAVINGS CLAUSE;
PROVIDING A PENALTY NOT TO EXCEED ONE THOUSAND
DOLLARS ($1,000.00) AND A SEPARATE OFFENSE SHALL BE
DEEMED COMMITTED EACH DAY DURING OR ON WHICH A
VIOLATION OCCURS OR CONTINUES; PROVIDING A SEVER-
ABILITY CLAUSE; DECLARING AN EMERGENCY AND PRO-
VIDING AN EFFECTIVE DATE
WHEREAS, the City Council of the City of The Colony, Texas (the "City")
is empowered pursuant to article 1011d of the Texas Revised Civil Statutes to
amend the Zoning ~Ordinances of the City; and
WHEREAS, Public Notice was given in compliance with State law and a
Public Hearing was conducted with respect to the amendment to the City's
Zoning Ordinances as hereinafter set forth; and
WHEREAS, after due deliberation and consideration of all the information
submitted to the City Council, including the information submitted during the
Public Hearings, the City Council has concluded that it is in the public's best
interest and in support of the health, safety, morals and welfare of the City that
Appendix A-Zoning of the Code of Ordinances of the City be amended as
hereinafter set forth.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF THE COLONY, TEXAS.
Section 1. That all of the above premises are found to be true and
correct and are incorporated into the body of this ordinance as if copied in their
entirety.
Section 2. That Appendix A-Zoning of the Code of Ordinances of the
City of The Colony, Texas is hereby amended in the following particulars, and
that all other sections, subsections, sentences, clauses, words and phrases of
Appendix A-Zoning are not amended but are hereby ratified, verified, approved
and affirmed:
A. That Section 11-300 of the Code of Ordinances relating to the
minimum enclosed living area for a dwelling unit be amended to read as follows:
"11-300. Dwelling area. The minimum enclosed living area for a
dwelling unit located in the various districts shall be in accordance
with the following schedule:
"(11-301) Schedule of minimum floor area per dwelling unit
"District Minimum floor area per dwelling unit
SF (Single Family residence only) 1,300 sq. ft."
Section 3. This ordinance shall be cumulative of all other zoning
ordinances of the City and shall not repeal any of the provisions of said
ordinances except in those instances where provisions of those ordinances are in
direct conflict with the provisions of this ordinance.
Section 4. Any person violating any of the provisions of this ordinance
shall be deemed guilty of a misdemeanor and upon conviction thereof shall be
subject to a fine in a sum not to exceed One Thousand Dollars ($1,000.00) for
each offense and a separate offense shall be deemed committed upon each day
during or on which a violation occurs or continues.
Section 5. The fact the present ordinances and regulations of tjhe City
of The Colony, Texas are inadequate to proerly safeguard the health, safety,
morals, peace, and general welfare of the inhabitants of the City of The Colony,
Texas, creates an emergency for the immediate preservation et the public
business, property, health, safety, and general welfare of the public which
requires that this ordinance become effective from and after the date of its
passage and it is accordingly so ordained.
