HomeMy WebLinkAboutOrdinance No. 328 CITY OF THE COLONY, TEXAS ORDINANCE NO. ~D~ AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS INCREASING AND SETTING A WARRANT FEE; REPEALING ALL PREVIOUSLY ENACTED ORDINANCES OR RESOLUTIONS OF THE CITY OF THE COLONY, TEXAS INCONSISTENT HEREWITH; PROVIDING A SEVERABILITY CLAUSE; PROVIDING AN EFFEC- TIVE DATE AND DECLARING AN EMERGENCY NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: Section 1. That a warrant fee charged as a special expense each time any person is required to or agrees to appear in the municipal court and fails to do so, thereby cansing the issuance and service of a warrant of arrest for such person for the purpose of bringing such person before the municipai court, shall be established in the amount of Twenty Five Dollars ($25.00). Such warrant fee shall also be charged for the issuance and service of any warrant of arrest after due notice has been given for any reason. The warrant fee shah be paid into the City Treasury for the use and benefit of the City. Section 2. That all ordinances and resolutions of the City of The Colony, Texas previously enacted by the City Council which are inconsistent with this ordinance are hereby repealed. Section 3. If any section, article, paragraph, sentence, clause, phrase or word in this ordinance, or appiication thereto any person or circumstance is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of the ordinance; and the City Council hereby declares it wemd have passed such remaining portions of the ordinance despite such invalidity which remaining portions shall remain in full force and effect. Section 4. The fact that the present ordinances and regulations of the City of The Colony, Texas, are inadequate to properly safeguard the health, safety, morals, peace, and genera1 welfare of the inhabitants of the City of The Colony, Texas, creates an emergency for the immediate preservation of public business, property, health, safety, and general welfare of the public which requires that this ordinance shall become effective from and after the date of its passage and it is according!y so ordained.
