AN ORDINANCE AMENDING ORDINANCE NUMBER 2~'7 .-OF
THE CITY OF THE COLONY, TEXAS, BY AMENDING TH~
LEGAL DESCRIPTION OF THAT PORTION OF THE STREET
AND RIGHT OF WAY ABANDONED IN ORDINANCE NUMBER
2#7~ SAID STREET BEING STEV/ART'S CREEK ROAD~ BY
ADDING TO SAID LEGAL DESCRIPTION; PROVIDING AN
EFFECTIVE DATE AND DECLARING AN EMERGENCY.
WHEREAS~ the City of The Colony, Texas~ (the "City") has~ by Ordinance
Number 2t~7~ abandoned a portion of Stewart's Creek Road in favor o£ Fox & Jacobs,
Inc. for the reason that such street and right of way was no longer needed for public
purposes; and
WHEREAS~ said street and right of way were abandoned in favor of Fox &
3acobs~ Inc. for and in consideration of the payment of the fair market value of the
land and improvements therein contained as determined by an appraisal obtained by
the City; and
WHEREAS~ a portion of said street and right of way abandoned by the City
was left out of the legal description contained in Ordinance Number 2#7.
NOW~ THEREFORE~ BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF THE COLONY~ TEXAS:
Section 1. That the above and foregoing preamble is incorporated herein as
if copied herein in its entirety.
Section 2. That Ordinance Number 2t47 of the City of The Colony~ Texas~
(the "City") is amended by adding to the legal description contained in Section 1 of
said Ordinance the following legal description:
"Being a strip of land 3t~ feet in width situated in the games
L. Sparks Survey~ Abstract No. 11797 the B.B.B. & C.R.R.
Survey, Abstract No. lgl, and the S. E. Hayes Survey~
Abstract No. 6#87 Denton County Texas~ and having a center
line more particularly described as follows:
"BEGINNING at a point in th~ West line of F.M. Road No.
#237 said point being S 00° 07' 10" E along said West line,
290.39 feet from its itnersection with the South line of North
Colony Blvd.;
"THENCE S 89° 33' 15" W7 679.96 feet;
THENCE S 89° 32' t~7" W, 93#.73 feet;
THENCE S 89° #3' 02" W, 635.08 feet to the end of this
abandonment and containing 1.736 acres of land."
Section 3. The fact that the present ordinances and regulations of the
City are inadequate to properly safeguard the health7 safety, morals7 peace and
general welfare of the inhabitants of the City creates an emergency for the
immediate preservation of the public business, property~ health~ safety and general
welfare of the public which requires that this ordinance shall become effective from
and after the date of its final passage and publication as provided by law~ and it is
accordingly so ordained.
