AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, AMENDING THE CODE OF ORDINANCES BY AMENDING CHAPTER 15 RELATING TO PEDDLERS AND SOLICITORS BY AMENDING SECTION 15-8 TO REQUIRE THE WEARING OF A PHOTOGRAPHIC IDENTIFICATION BADGE PROVIDING A PENALTY NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED UPON EACH DAY DURING OR ON WHICH A VIOLATION OCCURS; PROVIDING A SEVERABILITY CLAUSE; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: Section 1. That Chapter 15 of the Code of Ordinances is hereby amended in the following particulars and that all other existing sections, subsections, paragraphs, sentences, definitions, phrases and words of said Code of Ordinances are not amended but shall remain intact and are hereby ratified, verified, approved and affirmed: A. That a Section 15-8 be amended to read as follows: "Sec. 15-8 Carrying license, permit and photographic identifi- cation. It shall be unlawful for any person to engage in any activity for which a permit or license is required by this chapter without carrying such permit or license on the person while so engaged. It shall be further be unlawful for any person to engage in any activity for which registration or a permit or license is required by this chapter without wearing a photographic identification badge issued by the Chief of Police on the person so as to be visible at all times while so engaged. A fee of $ ~,,~ shall be charged for every photographic identification badge issued." Section 2. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof, shall be fined in a sum not to exceed Two Hundred Dollars ($200.00) for each offense and a separate offense shall be deemed committed upon each day during or on which a violation occurs or continues. Section 3. If any section, article, paragraph, sentence, clause, phrase or word in this ordinance or application thereto any person or circumstance is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance; and the City Council hereby declares it would have passed such remaining portions of this ordinance despite such invalidity, which remaining portions shah remain in full force and effect. Section 4. The fact that the present ordinances and regulations of the City are inadequate to properly safeguard the health, safety, and general welfare of the public which requires that this ordinance shall become effective from and after the date of its final passage and publication as provided by law, and it is accordingly so ordained.
