AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF THE COLONY, TEXAS BY AMENDING CHAPTER 6 RELATING TO BUILDINGS, CONSTRUCTION AND RELATED ACTIVITIES BY AMENDING SECTION 6-3 RELATING TO AMEND- MENTS TO THE 1984 NATIONAL ELECTRICAL CODE; PRO- VIDING FOR REPEAL OF ALL INCONSISTENT ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING AN EFFEC- TIVE DATE AND DECLARING AN EMERGENCY NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: Section 1. That Chapter 6 of the Code of Ordinances of the City of The Colony, Texas (the "City") relating to buildings, construction and related activities is amended in the following particulars, and all other existing Sections, Subsections, Paragraphs, Sentences, Definitions, Phrases and Words of said Code of Ordinances are not amended but shall remain intact and are hereby ratified, verified, approved and affirmed: A. That Section 6-3 is hereby amended by amending subsection (8) and by adding new subsection (10), which shall read as follows: "Sec. 6-3. Same - Amendments. "(8) Whenever any electrical or other utility service, including but not limited to natural gas, telephone, or cable television, is provided via underground cable or pipe, the cable or pipe shall run parallel to and be located within two (2) feet of a property line or driveway. If a fence is already in place along a property line at the time such underground cable or pipe is installed, such cable or pipe may be buried a maximum of four (4) feet from the property line on which such fence is constructed; provided, however, that if a driveway abuts or is adjacent to such fence at the time of installation, such cable or pipe shall be buried a maximum of two (2) feet from the driveway.( Once the buried cable or pipe passes the buildable portion of the rear yard of any property, such cable may be buried at an angle to the side of a structure located on the property.~ No cable or pipe shall run or be located diagonally across any portion of a lot. "(10) All main electrical panels containing overcurrent devices shall be located in the garage of all single family residential structures." Section 2. All ordinances of the City of The Colony, Texas inconsistent or in conflict with the provisions of this ordinance are hereby repealed to the extent they are inconsistent or in conflict herewith. Section 3. If any section, article, paragraph, sentence, clause, phrase or word in this ordinance, or application thereto any person or circumstance is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of the ordinance; and the City Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 4. The fact that the present ordinances and regulations of the City are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the inhabitants of the City creates an emergency for the immediate preservation of the public business, property, health, safety and general welfare of the public which requires that this ordinance shall become effective from and after the date of its final passage and publication as provided by law, and it is accordingly so ordained.
