HomeMy WebLinkAboutOrdinance No. 353 CITY OF THE COLONY, TEXAS ORDINANCE NO. ~ AN ORDINANCE AMENDING APPENDIX B-SUBDIVISION OF THE CODE OF ORDINANCES OF THE CITY OF THE COLONY, TEXAS BY AMENDING SECTION 16 RELATING TO FEES BY AMENDING SUBSECTIONS 16(A), (B), AND (C); DETERMINING THAT THE CHANGE IN THE SUBDIVISION REGULATIONS HAVE BEEN MADE TO PROMOTE THE HEALTH, SAFETY, MORALS AND WELFARE OF THE COMMUNITY; PRESERVING ALL OTHER PARTS OF APPEN- DIX B-SUBDIVISION; PROVIDING A SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE DATE AND DECLARING AN EMER- GENCY NOW, THEREFORE, BE ORDAINED BY T}~ CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: Section 1. That Appendix B-Subdivision of the Code of Ord- inances of the City of The Colony, Texas (the "City") is amended in the following particulars and that all other existing Sections, Subsections, Paragraphs, Sentences, Definitions, Phrases and Words of said Code of Ordinances are not amended but shall remain intact and are hereby ratified, verified, approved and affirmed: A. That Section 16 of Appendix B-Subdivision is amended to read as follows: "Sec. 16. Fees. "(a) Preliminary plat: $200.00 plus $2.00 per lot. "(b) Final plat: $300.00 plus $3.00 per lot. "(c) Replat: $300.00 plus $3.00 per lot." Section 2. That the subdivision regulations as herein es- tablished have been made for the purpose of promoting the health, safety, morals and the general welfare of the community. Section 3. This ordinance shall be cumulative of all other ordinances of the City affecting subdivisions and shall not repeal any of the provisions of said ordinances except in those instances where provisions of those ordinances are in direct conflict with the provisions of this 6rdinance. Section 4. If any section, article, paragraph, sentence, cl.ause, phrase or word in this ordinance, or application thereto any person or circumstance is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of the ordinance; and the City Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity, which remain- ing portions shall remain in full force and effect. Section 5. The fact that the present ordinances and reg- ulations of the City of The Colony, Texas, are inadequate to pro- perly safeguard the health, safety, morals, peace, and general welfare of the inhabitants of the City of The Colony, Texas, creates an emergency for the immediate preservation of public business, property, health, safety, and general welfare of the public which requires that this ordinance shall become effective from and after the date of its passage and it is accordingly so ordained.
