HomeMy WebLinkAboutOrdinance No. 280 CITY OF THE C~)LONY, TEXAS ORDINANCE NO. 280 AN ORDINANCE AMENDING CHAPTER 17 OF THE CODE OF ORDINANCES, CITY OF THE COLONY, TEXAS, BY AMENDING SECTION 17-2 RELATING TO MEMBERSHIP OF THE PLANNING AND ZONING COMMISSION; PROVIDING A SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE DATE AND DECLARING AN EMERGENCY. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: Section 1. That Section 17-2 of Chapter 17 of the Code of Ordinances, City of The Colony, Texas, relating to membership of the Planning and Zoning Commission is hereby amended to add two additional members of the Planning and Zoning Commission by amending Section 17-2 in the following particulars, and all other existing sections, subsections, paragrphs, sentences, definitions, phrases and words of said Code of Ordinances are not amended but, shall remain intact and are hereby ratified, verified and affirmed. A. That Section 17-2(a) is amended to read as follows: "(a) The commission shall consist of seven (7) members appointed by a majority of the City Council." B. That Section 17-2(c) is amended to read as follows: "(c) Each member of the commission shall occupy a specific place, such places being numbered 1, 2, 3, 4, 5, 6 and 7 respectively. Upon initial appointment to the commission each member shall draw for their respective places and thereafter appointments shall be made to fill vacancies in a specific place." C. That Section 17-2(d) is amended to read as follows: "(d) Initially the term for places 1 and 2 shall expire May 31, 1979, the terms for places 3, 4 and 5 shall expire May 31, 1978, and the terms for the newly created places 6 and 7 shall expire May 31, 1985. Upon expiration of the respective terms of office as herein provided, there shall be appointed as to each place, a member of the commission to serve a two (2) year term, and until their successors are appointed and qualified." Section 2. If any section, article, paragraph, sentence, clause, phrase or word in this ordinance or application thereto any person or circumstance is held invalid or unconstitutional by a Court of competent jurisdiction such holding shall not affect the validity of the remaining portions of the ordinance; and the City Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 3. The fact that the present ordinances and regulations of the City of The Colony, Texas, are inadequate to properly safeguard the health, safety, morals, peace, and general welfare of the inhabitants of the City of The Colony, Texas, creates an emergency for the immediate preservation of the public business, property, health, safety, and general welfare of the public which requires that this ordinance shall become effective from and after the date of its passage and it is accordingly so ordained.
