HomeMy WebLinkAboutOrdinance No. 286 CITY OF THE COLONY, TEXAS ORDINANCE NO. ~,~[~ AN ORDINANCE AMENDING CHAPTER 6, OF THE CODE OF ORDINANCES OF THE CITY OF THE COLONY, TEXAS, BY AMENDING ARTICLE I, SECTION 6-2 TO PROVIDE FOR ADOP- TION OF THE 1984 NATIONAL ELECTRIC CODE AND AN AMENDMENT THERETO; AND BY AMENDING ARTICLE I, SEC- TION 6-3 RELATING TO AMENDMENTS; PROVIDING FOR RE- PEAL OF ALL INCONSISTENT ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE DATE NOW, THERFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: Section 1. That Chapter 6 of the Code of Ordinances of the City of The Colony, Texas, is hereby amended in Article I, Section 6-2, so that said section shall hereafter read as follows: "Section 6-2. Electrical Code - Adopted. (a) The National Electric Code, 1984 Edition, published by the National Fire Protection Association, is hereby adopted as the electrical code of the city. A true and correct copy of said National Electric Code shall be kept in the office of the city secretary and be made available for inspection during regular business hours. (b) The electrical code herein above adopted, is hereby amended as follows: Section 300-22(c). Exception No. 6 is hereby added to read as follows: "(Exception No. 6: This section does not include the return air spaces of a dwelling unit.)" Section 2. That Chapter 6 of the Code of Ordinances of the City of The Colony, Texas, is hereby amended in Article I, Section 6-3 to add subsections (8) and (9) which subsections shall read as follows: "(8) Whenever electrical or any other utility service, including but not limited to natural gas, telephone, or cable television, is provided via underground cable or pipe, the cable or pipe shall run parallel to and be located within two (2) feet of a property line. No cable or pipe shall run or be located diagonally across any portion of a lot. (9) All underground utility services shall be buried to the following minimum depths: (a) Electrical: 24 inches. (b) Natural gas: 24 inches. (c) Telephone: 12 inches. (d) Cable television: 12 inches. (e) Ail other services: 12 inches." Section 3. Ail ordinances of the City of The Colony, Texas, inconsistent or in conflict with the provisions of this ordinance or the Codes adopted hereby is hereby repealed to the extent of the inconsistency or conflict. Section 4. If any section, article, paragraph, sentence, clause, phrase or word in this ordinance or application thereto any person or circumstance is held invalid or unconstitutional by a Court of competent jurisdiction such holding shall not affect the validity of the remaining portions of the ordinance; and the City Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 5. This ordinance shall become effective from and after the date of its passage and it is accordingly so ordained.
