AN ORDINANCE CALLING TWO (2) PUBLIC HEARINGS IN
ACCORDANCE WITH TEX. REV. CIV. STAT. ANN. ART. 970a
MUNICIPAL ANNEXATION ACT AND SECTION 1.03, OF CHAP-
TER I OF THE HOME RULE CHARTER OF THE CITY OF THE
COLONY, TEXAS, ADOPTED JANUARY 20, 1979, FOR THE
PURPOSE OF CONSIDERING THE INSTITUTION OF ANNEXA-
TION PROCEEDINGS TO ANNEX ALL THAT LOT, TRACT,
PARCEL OF LAND DESCRIBED IN EXHIBIT "A" WITH THE FIRST
PUBLIC HEARING TO BE CONDUCTED WITHIN THE SITE TO BE

PROVIDING FOR PUBLICATION OF NOTICE; DIRECTING PREP-
ARATION OF A SERVICE PLAN FOR INSPECTION AT THE
PUBLIC HEARINGS.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF THE COLONY, TEXAS:
Section 1. That pursuant to and in accordance with Tex. Rev. Civ. Stat.
Ann. art. 970a and Section 1.03, of Chapter I of the Home Rule Charter of the
City of The Colony, Texas, adopted January 20, 1979, two (2) public hearings to
consider institution of annexation proceedings to annex that lot, tract, and
parcel of land described in Exhibit "A" which is attached hereto and incorporated
herein as if copied in its entirety into the body of this ordinance are hereby
called as follows:
(a) Public hearing within the site to be annexed is set for the

(b) Public hearing at the City Hall, 5576 North Colony Boulevard, The
Colony, Texas, is set for the Igq4~ day of C)~--~o~ , 1984 at

Section 2. All interested persons shall be given the opportunity to be
heard at said public hearings which shall be conducted and held not more than
forty (40) days nor less than twenty (20) days prior to the institution of
annexation proceedings.
Section 3. Notice of Public Hearing.
(a) Notice of this public hearing shall be published in a newspaper
having general circulation in the City, and in the territory proposed to be
annexed. Said notice shall be accomplished by publication of this
ordinance in its entirety, including Exhibit "A" at least once in said
newspaper not more than twenty (20) days nor less than ten (10) days prior
to each public hearing.
(b) Additional notice by Certified Mail shall be given to railroad
companies, if any, serving the City and on the City's tax roll where the
right of way is located within the territory to be annexed.
Section 4. The City Council hereby directs the City Manager to prepare
a service plan that provides for the extension of municipal services into the area
to be annexed in accordance with Section 10 of TEX. REV. CIV. STAT. ANN. art.
970a. Said Service p]an shall be made available for inspection and explained to
the inhabitants of the area to be annexed at the public hearings.
Section 5. That this ordinance shall take effect from and after its
passage.

EXHIBIT "A"
Ail that certain lot, tract, or parcel of land lying and being situated in the County
o£ Denton, State of Texas~ and being part of St. Louis~ San Francisc% and Texas
Railroad right-of-way, being out of MDT Hallmark Survey, Abstract No. 570, and
being more particularly described as follows:
BEGINNING at a steel pin located in the south boundary line of the MDT Hallmark
Survey~ the same point being the southeast corner of the city limits boundary of
The Colony, Texas;
THENCE North 88 degrees~ 52 minutes~ 30 seconds East~ along the South boundary
line of the MDT Hallmark Survey, for a distance of 71 feet to a point of intersect
with the West boundary line of the St. Louis, San Francisc% Texas Railroad right-of-way,
and continues along said course for approximately a total distance of 171 feet
to the East boundary line of said Railroad right-of-way;
THENCE North, 5 degrees, 55 minutes, 50 seconds East along the East right-of-way
line of the said Railroad, 50 feet from~ and at right angles to~ the center line
of said Railroad right-of-way, for a distance of 2~500 feet;
THENCE South 88 degrees, 52 minutes~ 30 seconds West~ for a distance of approximately
100 feet~ to a point of intersect with the West right-of-way line of said Railroad;
THENCE South 5 degrees~ 55 minutes~ 50 seconds West~ along the West right-of-way
line of the said Railroad~ and then 50 feet from~ and at right angles toy the center
line of said Railroad right-of-way~ for a distance of 1,5#7 feet, to a steel pin for
a corner;
THENCE North 83 degrees, #3 minutes West~ for a distance of 190 feet, for a corner;
THENCE South 1 degre% 7 minutes, 30 seconds East, for a distance of 970 feet
to a point on the South boundary line of the MDT Hallmark Survey, said point
being the point of beginning.
