HomeMy WebLinkAboutOrdinance No. 301 ORDINANCE CITY OF THE COLONY, TEXAS AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS AMENDING THE CODE OF ORDINANCES BY AMENDING ~.ECTION 19-11 ¢,ITH RESPECT TO SCHOOL TRAFFIC ZONES; DIRECTING THE ERECTION OF NECESSARY SIGNS; PROVIDING A PENALTY NOT TO EXCEED T~,~O HUNDRED DOLLARS [-'OR EACH OFFENSE AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED UPON EACH DAY DURING OR ON WHICH A VIOLATION OCCURS; REPEALING ALL INCON- SISTENT ORDINANCES PROVIDING A SEVERABILITY ~ND PROVIDING AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: Section 1. That Chapter 19 of the Code of Ordinances of the City of The Colony, Texas is hereby amended in the following particulars and all other existing sections, subsections, paragraphs, sentences, definitions, phrases and words of said Code are hereby ratified, verified and affirmed: A. That Section 19-11 is hereby amended to read as follows: "See, 19-11. Same--In school traffie zones. (a) Upon the basis of an engineering and traft'ie in- vestigation, the following streets are designated school traffic zones. The maximum lawful prima faeie speed limits hereinafter indicated for vehicles are herebv determined and deelared to be reasonable and safe, and such ~peed limits are hereby fixed for vehicles traveling upon the following named streets an(~ highways, or parts thereof, during the hereinafter designated hours on sheool days, either when such hours are described on official school traffic zone speed limit signs Ideated at said zones or when school traffic zone signs bearing a flashing amber light and Ideated at said zones are in operation. Said speed limits shall be in effect on school days from the hours of 7:00 a.m., to 9:00 a.m.,, and from 2:30 p.m., to 4:00 p.m. The maximum lawfulpmma faeie speed limit in said school traffic zones during said horns shall be twenty (20) miles per hour. The Ideations of said school traffic zones are as follows: Street Extent South Colony Blvd. From a point 600 feet east of its intersection with Blair Oaks Drive to a point 200 feet west of its intersection with Alta Oaks Lane. Blair Oaks Drive From a point 300 feet north of its intersection with S. Colony Blvd., to the point of its intersection with Arbor Glen Road. Arbor Glen Road From the point of its intersection with Ash Glen Lane to a point 200 feet east of Blair Oaks Drive. Nash Drive From a point 600 feet west of John Yates Street to the point of its inter- section with Miller Drive. John Yates Street From the point of its intersection with Roberts Drive to the point of its inter- section with Shannon Drive. N. Colony Blvd. From a point 150 feet east of its intersection with Allen Drive to a point 533 feet west of its intersection with Ragan Drive. N. Colony Blvd. }'rom a point 350 feet west of Blair Oaks Road to a point 260 feet west of 423 (Main Street). Paige Road ]~'rom a point 25 feet south of its intersection with Kisor Drive to a point 25 feet south of its intersection with Gibson Drive. Augusta St. From a point 250 feet east of Anderson Drive to a point 730 feet west of Anderson Drive. Anderson Dr. From a point 540 feet south of Augusta Street to its intersection point with Augusta Street. (b) Upon the basis of an engineering and traffic in- vestigation heretofore made as authorized by the provisions of section 169(b) of Article 6701 d, Vernon's Texa~ Civil Statutes, the following prima facia speed limits hereafter indicated for vehicles are hereby determined and declared to be reasonable and safe; and such speed limits are hereby fixed at the rate of speed indicated for vehicles traveling upon the named streets and highways, or parts thereof, described as follows: No motor vehicle shall be operated along and upon Farm Road Highway No. 423 within the corporate limits of the city in excess of the speeds now set forth in the following limits. Beginning at said point being the north city limits on Farm Road 423; thense continuing in o southerly direction for a distance of 0.341 mile (1,800 feet), approximately, a maximum speed of thirty (30) miles per hour when so signed for school crossing locations. Said speed limit shall be in effect on school days from the hours o£ 7:00 a.m. to 9:00 a.m., fromii:00 a.m. to 12:00 p.m., and from 2:30 p.m. to 4:00 p.m." Section 2. The City Manager, the Chief of Police or such represent- ative as either of said officials may appoint, is hereby authorized and directed to cause appropriate signs to be posted and maintained giving notice of the maximum speed limit on school days during the hours designated in Section I of this Ordinance. Section 3. Any person violating any of the provisions of this Ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to exceed Two Hundred Dollars ($200.00) for each offense and a separate offense shall be deemed committed upon each day during or on which a violation occurs or continues. Section 4. All ordinances or parts of ordinances inconsistent or in conflict with the provisions of this Ordinance, including Ordinance No. 293 passed and approved on August 20, ]984, are hereby expressly repealed. Section 5. If any section, article, paragraph, sentence, clause, phrase or word in this Ordinance or application thereto any person or circumstance is held invalid or unconstitutional by a Court of competent jurisdiction such holding shall not affect the validity of the remaining portions of this Ordinance; and the City Council hereby declares it would have passed such remaining portions of this Ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 6. This Ordinance shall become effective from and after the date of its passage and publication and it is accordingly so ordained.
