AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS,
AMENDING ORDINANCE NO. 120 OF THE CITY OF THE
COLONY, TEXAS, PASSED AND APPROVED BY THE CITY
COUNCIL ON SEPTEMBER 29, 1980 BY AMENDING SECTION 2
RELATING TO PERMIT AND INSPECTION FEES FOR CON-
STRUCTION; REPEALING ALL INCONSISTENT ORDINANCES
AND RESOLUTIONS; PROVIDING A PENALTY NOT TO EXCEED
THE SUM OF TWO HUNDRED DOLLARS ($200.00) FOR EACH
OFFENSE AND A SEPARATE OFFENSE SHALL BE DEEMED
COMMITTED UPON EACH DAY DURING OR ON WITH A
VIOLATION OCCURS; PROVIDING A SEVERABILITY CLAUSE;
AND PROVIDING AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF THE COLONY; TEXAS:
Section ]. That Ordinance 120 of the City of The Colony, Texas (the
"City") passed and approved by the City Council on September 29, 1980 is hereby
amended in the following particulars and all other existing Sections are not
amended but shall remain intact and are hereby ratified, verified, and affirmed:
A. That Section 2 is amended to read as follows:
"Section 2. The permit and inspection fees provided in
Chapter 3 shall be applicable to all construction or work except
Single-Family Residential construction. There shall be a flat
inspection and permit fee for Single-Family Residential con-
struction of Four Hundred Dollars ($400,00) per unit. Such fee and
the other fees provided in Chapter 3 of the Code may hereafter be
adjusted from time to time by ordinance of the City Council of the
City of The Colony."
Section 3. Any person violating any of the provisions of this Ordinance
shall be deemed guilty of a misdemeanor and upon conviction thereof shall be
fined in a sum not to exceed Two Hundred Dollars ($200.00) for each offense and
a separate offense shall be deemed committed upon each day during or on which
a violation occurs or continues.
Section 4. If any section, article, paragraph, sentence, clause, phrase or
word in this Ordinance or application thereto any person or circumstance is heId
invalid or unconstitutional by a Court of competent jurisdiction such holding
shall not affect the validity of the remaining portions of this Ordinance; and the
City Council hereby declares it would have passed such remaining portions of
this Ordinance despite such invalidity, which remaining portions shall remain in
full force and effect.
Section 5. This Ordinance shall become effective from and after the
date of its passage and publication and it is accordingly so ordained.
