HomeMy WebLinkAbout09/23/03 P&ZPlanning and Zoning Commission September 23, 2003 MINUTES OF THE PLANNING AND ZONING COMMISSION MEETING HELD ON SEPTEMBER 23, 2003 The Regular Session of the Planning and Zoning Commission of the City of The Colony, Texas was called to order at 6:30 p.m. on the 23rd day of September, 2003 at City Hall with the following members present: Bill Jamme, Vice Chairman Bill Harrison Kirk Mikulec - Tardy Brian Wade DeWayne Snider Absent: Deville Hubbard, Chairman Staff.' Harry Persaud, Director of Development Services Chris Spencer, Planner James Hanvey, Staff Engineer Sandy Vondersaar, Administrative Assistant With four (4) P & Z members present, a quorum was established and the following items were addressed: 2.0 DISPOSITION OF MINUTES 2.1 Approval and/or correction of Planning and Zoning Commission Minutes for the meeting held on August 26, 2003. Motion to approve the minutes of the meeting held on August 26, 2003, Commissioner Snider; second, Commissioner Wade. Motion carried 4-0. 3.0 CITIZEN INPUT None 4.0 PUBLIC HEARING 4.1 Hold a public hearing and consider a recommendation to the City Council -1- Planning and Zoning Commission September 23, 2003 regarding an amendment to the Comprehensive Zoning Ordinance of The City of The Colony, providing a definition and regulations for Temporary Buildings and providing for an effective date. The proposed amendment relates to Portable Buildings in the City. Vice Chairman Jamme opened the public hearing at 6:32 p.m. Mr. Spencer presented the staff report regarding approval of an amendment to the Comprehensive Zoning Ordinance providing a definition and regulations for Temporary Buildings (portable buildings) in the City. Reverend Brace Scofield of the First Baptist Church of The Colony, 4800 South Colony Boulevard, came forward to speak in favor of this item. Commissioner Mikulec arrived at 6:43 p.m. Mr. Persaud asked the Commission for their input and direction. After discussion the Commission stated their suggestions and additions to the amended Comprehensive Zoning Ordinance. Staff recommends approval with the Commissions' stipulations. Vice Chairman Jamme closed the public hearing 6:52 p.m. A motion to amend the Comprehensive Zoning Ordinance of The City of The Colony, providing a definition and regulations for Temporary Buildings and providing for an effective date. The proposed amendment relates to Portable Buildings in the City with stipulations, Commissioner Harrison; second Commissioner Wade. Motion carried 5-0. 4.2 Hold a public hearing and consider approval of a Specific Use Permit allowing for the packaging of alcoholic beverages, at 7204 Elm Street, Suite 105, located on the east side of Elm, north of Witt and south of E. Lake Highlands, in the City of The Colony, Denton County, Texas. (2003-SUP007) Vice Chairman Jamme opened the public hearing at 6:53 p.m. Mr. Spencer presented the staff report regarding approval of a Specific Use Permit allowing for the packaging of alcoholic beverages at 7204 Elm Street, Suite 105, located on the east side of Elm, north of Witt and south orE. Lake Highlands. He stated thirty- one (31) notices were mailed and to date eight (8) have been received. Five (5) in opposition, two (2) in favor and one (1) undecided. Ms. Debbie Bates of DebLee Enterprises, 7204 Elm Street, Suite 105, was present to answer questions. -2- Planning and Zoning Commission September 23, 2003 No one came forward to speak in favor of this item. The following residents came forward to speak against this item: Ms. Beth Wagstaff- 7301 Knight Drive Mr. Jeffi'ey B. DeSimone - 7205 Knight Drive Ms. Amy Thomas - 7217 Knight Drive Ms. Rubie Gonzalez - 7213 Knight Drive Ms. Bates addressed their concerns. Staff recommends approval subject to two (2) stipulations. Vice Chairman Jamme closed the public hearing at 7:22 p.m. A motion to deny approval of a Specific Use Permit allowing for the packaging of alcoholic drinks at 7204 Elm Street, Suite 105, located on the east side of Elm, north of Witt and south of E. Lake Highlands, in the City of The Colony, Denton County, Texas. (2003-SUP007), Commissioner Harrison; second Commissioner Mikulec. Motion carried 4-1. Commissioners Harrison, Mikulec, Wade and Snider for; Commissioner Jamme against. 5.0 ITEMS FOR CONSIDERATION 5.1 Consider a request for approval of a Preliminary and Final Plat for Lot 1, Block 1, Austin Ranch Substation Addition, being a 5.280-acre tract situated in David Andrews Survey, Abstract No. 18, located east of Piano Parkway, south of SH 121, and north of Windhaven, in the City of The Colony, Denton County, Texas. (2003-PP002 & 2003-FP004) Mr. Spencer presented the staff report regarding approval of a Preliminary and Final Plat for the Austin Ranch Substation Addition located east of Plano Parkway, south of State Highway 121, and north of Windhaven. Mr. Dallas Cothrum of Masterplan, 500 S. Ervay Street, Suite 1128, Dallas, Texas 75201 was present to answer questions. Staff recommends approval subject to nine (9) staff stipulations. A motion for approval of a Preliminary and Final Plat for Lot 1, Block 1, Austin Ranch Substation Addition, being a 5.280-acre tract situated in David Andrews Survey, Abstract No. 18, located east of Piano Parkway, south of SH 121, and north of Windhaven, in the City of The Colony, Denton County, Texas. (2003-PP002 & 2003-FP004) with staff stipulations, Commissioner Snider, second Commissioner Harrison. Motion carried 5-0. -3- Planning and Zoning Commission September 23, 2003 5.2 Consider a request for approval of a curb cut to allow the Hidden Cove residential subdivision access to Standridge Drive. The subject tract is located west of Standridge Drive, and north of Kennepac Road, in the City of Lewisville. (2003-M023). Mr. Spencer presented the staff report regarding approval of a curb cut located west of Standridge Drive and north of Kennepac Road in the City of Lewisville. Mr. Matt Robinson of Carter and Burgess, 7950 Elmbrook Drive, Dallas, Texas 75247 was present to answer questions. Staff recommends approval subject to two (2) staff stipulations. A motion for approval of a curb cut to allow the Hidden Cove residential subdivision access to Standridge Drive. The subject tract is located west of Staudridge Drive, and north of Kenuepac Road, in the City of Lewisville. (2003- M023) subject to staff stipulations, Commissioner Harrison, second Commissioner Wade. Motion 5-0.
