HomeMy WebLinkAboutOrdinance No. 314 cl-ry OF THE COLONY, TEXAS ORDINANCE' NO. ~ AN ORDINANCE AUTHORIZING CERTAIN TEMPORARY OUTSIDE SALES; AUTHORIZING APPLICATION TO MAKE SUCH SALES TO BE MADE TO THE BUILDING OFFICIAL; AUTHORIZING THE BUILDING OFFICIAL TO ESTABLISH RULES AND REGULATIONS GOVERNING TEMPORARY SALES ~/HEREAS, the City of The Colony, Texas (the "City") is a home rule city pursuant to rex. Rev. Civ. Stat. Ann. Art. 1165 et seq (Vernon 1963); and ~/HEREAS~ the City is empowered pursuant to rex. Rev. Civ. Stat. Ann. Art 101la (Vernon Supp. 198#) to regulate the use of buildings~ structures and land for trade, industry or other purposes; and ~I/HEREAS~ The City Council desires to authorize the temporary outside sale of certain items. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY~ TEXAS: Section 1. That all matters contained in the preamble are incorporated in this Ordinance as if copied herein in their entirety. Section 2. That temporary outside sales o£ certain items~ including but not limited to, firewood, Christmas trees, plants and flowers may lawfully take place during the periods approved by the Building Official at the time application for permit is made. Section 3. That the Building Official is hereby authorized to establish rules and regulations governing temporary outside sales, including a designation of the items or products that may be sold. Said rules and regulations shall be posted at the City Hall at all times during which temporary outside sales are permitted. Section 4. That all Applications to conduct temporary outside sales shall be submitted to the Building Official on a form to be provided by said Official. The Building Official, after review of the Application, shall make a determination as to whether or not any Application should be granted or refused. Any person, corporation, partnership, sole proprietorship or any other legal entity whose Application is refused by the Building Official may then appeal the Building Official's decision to the City Council for its review and determination. Section 5. That all temporary outside sales shall be conducted in accordance with the rules and regulations established by the Building Official pursuant to Section 3 of this Ordinance. Section 6. That this Ordinance shall take effect immediately from and after its passage. Section 7. That the City Secretary is hereby authorized to furnish copies of this Ordinance to all interested parties.
