HomeMy WebLinkAboutOrdinance No. 316 ORDINANCE 'NO. 00316 AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS, CANVASSING RE- TURNS AND DECLARING THE RESULTS OF A BOND ELECTION HELD IN SAID CITY ON THE 15TH DAY OF DECEMBER, 1984 THE STATE OF TEXAS § COUNTY OF DENTON § CITY OF THE COLONY § WHEREAS, this governing body, by ordinance duly passed and adopted, made provision for an election to be held within this City on the 15th day of December, 1984, for the purpose of submitting certain propositions for the issuance of general obligation bonds to the resident, qualified electors of the City; and WHEREAS, the returns of the said election have been made to this governing body and from an examination of those returns, it appears that the same was held in accordance with the authorized proceedings and was in all respects legally held after due notice had been given, and the said returns duly and legally made, and other instruments, showed the following results: PROPOSITION NO. 1 FOR THE ISSUANCE OF $2,060,000 GENERAL OBLIGA- 1073 Votes TION MUNICIPAL SERVICE CENTER COMPLEX BONDS (INCLUDING A RECREATION CENTER) AGAINST THE ISSUANCE OF $2,060,000 GENERAL OBLIGA- 240 Votes TION MUNICIPAL SERVICE CENTER COMPLEX BONDS (INCLUDING A RECREATION CENTER) PROPOSITION NO. 2 FOR THE ISSUANCE OF $590,000 GENERAL OBLIGA- 978 Votes TION LIBRARY FACILITIES BONDS AGAINST THE ISSUANCE OF $590,000 GENERAL OBLIGA- 328 Votes TION LIBRARY FACILITIES BONDS PROPOSITION NO. 3 FOR THE ISSUANCE OF $600,000 GENERAL OBLIGA- 940 Votes TION FIRE STATION FACILITIES BONDS AGAINST THE ISSUANCE OF $600,000 GENERAL OBLIGA- 363 Votes TION FIRE STATION FACILITIES BONDS PROPOSITION NO. 4 FOR THE ISSUANCE OF $850,000 GENERAL OBLIGA- 976 Votes TION PUBLIC SWIMMING POOL FACILITIES BONDS AGAINST THE ISSUANCE OF $850,000 GENERAL OBLIGA- 330 Votes TION PUBLIC SWIMMING POOL FACILITIES BONDS PROPOSITION NO. 5 FOR THE ISSUANCE OF $200,000 GENERAL OBLIGA- 826 Votes TION FARM-TO-MARKET ROAD 423 ELEVATED PEDESTRIAN CROSSOVER BONDS AGAINST THE ISSUANCE OF $200,000 GENERAL OBLIGA- 479 Votes TION FARM-TO-MARKET ROAD 423 ELEVATED PEDESTRIAN CROSSOVER BONDS PROPOSITI({N NO. 6 FOR THE ISSUANCE OF $700,000 GENERAL OBLIGA- 963 Votes TION PUBLIC PARK IMPROVEMENT AND ATHLETIC FACILITIES BONDS AGAINST THE ISSUANCE OF $700,000 GENERAL OBLIGA- 341 Votes TION PUBLIC PARK IMPROVEMENT AND ATHLETIC FACILITIES BONDS BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: Section 1. That all of the recitals contained in the preamble of this Ordinance are found to be true and are adopted as findings of fact by this governing body and as part of its judgment. Section 2. It is further found and determined that the results of the election as canvassed and tabulated in the preamble hereof reflect the expressed desires of the resident, qualified electors. Section 3. That in conformity with law, this governing body is authori'zed to issue bonds on behalf of said City in the amounts and for the purposes mentioned in the propositions set forth in the proceedings calling the election with respect to propositions numbered 1, 2, 3, 4, 5, and 6. PASSED, APPROVED AND EFFECTIVE this 17th day of December, 1984. bf~~y, Texas ATTEST: i ~Secretary APPROVED: [SEAL] -2- MINUTES AND CERTIFICATION'PERTAINING TO PASSAGE OF AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS, CANVASSING RETURNS AND DECLARING THE RESULTS OF A BOND ELECTION HELD IN SAID CITY ON THE 15TH DAY OF DECEMBER, 1984 THE STATE OF TEXAS § COUNTY OF DENTON § CITY OF THE COLONY § On this the 17th day of December, 1984, the City Council of the City of The Colony, Texas, convened in Regular Meeting at the regular meeting place thereof, the meeting being open to the public and notice of said meeting, giving the date, place and subject thereof, having been posted as prescribed by Article 6252-17, V.A.T.C.S., and the roll was called of the duly constituted officers and members of said City Council, which officers and members are as follows, to- wit: Larry D. Sample, Mayor Rick Harris Janice Carroll, City Manager Noel Long Janet Gadd, City Secretary Helen Gray Councilmembers Charles Dodds Marlene Poole Don Amick and all of said persons were present, except the following absentees: Noel Long, Don Amick, thus constituting a quorum. Whereupon, among other business, the following was transacted, to-wit: A written Ordinance bearing the following caption was introduced: "An Ordinance of the City Council of the City of The Colony, Texas, Canvassing Returns and Declaring the Results of a Bond Election Held in said City on the 15th Day of December, 1984". The Ordinance, a full, true and correct copy of which is attached hereto, was read and reviewed by the City Council. Thereupon, it was moved by Councilmember Poole and seconded by Councilmember Dodds that the Ordinance be finally passed and adopted. The Mayor put the motion to a vote of the members of the City Council, and the Ordinance was finally passed and adopted by the following vote: AYES: Five (5) NOES: None MINUTES APPROVED AND CERTIFIED TO BE TRUE AND CORRECT, and to correctly reflect the duly constituted officers and members of the City Council of said City, and the attached and following copy of said Ordinance is hereby certified to be a true and correct copy of an official copy thereof on file among the official records of the City, ali on this 17th day of December, 1964. ~ maY~ Y ' ' y, Tex~ ATTEST: City/~cretary APPROVED: [[SEAL]
