ORDIN^NCE NO.
AN ORDINANCE OF THE CITY OF THE COLONY PROHIBITING
THE CONSTRUCTION, RECONSTRUCTION OR TIEING IN TO
ANY STREET, PUBLIC OR PRIVATE, IN THE CITY OF TftE
COLONY THAT IS NOT IN CONFORMANCE WITH TIlE CITY'S
MASTEI{ STII. EET AND TllOROUGIIFARE PLAN; PROVIDING FOR
A PERMIT; PROVIDING A PENALTY NOT TO EXCEED THE SUM
OF ONE TIIOUSAND DOLLARS ($1,000.00) FOR EACIt OFFENSE
AND A SEPARATE OFFENSE SIIALL BE DEEMED COMMITTED

WIlERI'~AS, the City has based its Master Street and Thoroughfare Plan on
traffic studies aud projections, which traffic study and projections directly
affect the width of streets, traffic control devices and mechanisrhs needed and
affect all aspects of zoning and planning; and
WIIEI{EAS, it is necessary for the City in order to maintain the integrity
of its traffic system and its Master Street and Thoroughfare Plan to control,
review and approve all tie ins and street constrnction contiguous to all City
streets; and
WIIEREAS, tile City does declare that all tie ins of streets, pnblic or
private, to tile City's street syste~n must conform to the City's Master Strect
and Thoroughfare Plan and that all parties desiring to construct such streets
~nnst first obtain a street construction permit from the City.
NOW, "I'IIEREFOIIE, BE YP ORDAINED [IY TIlE CITY COUNCIL OF THE
CITY O1" TIII~ COLONY, TEXAS:
Section 1. That all matters stated in tile preamble are found to be true
and correct and are incorporated herein as if copied in their entirety.
Section 2. That it shall be unlawful for any person, party, individual,
corporation, either public or private, including municipal corporations, to
construct, or reconstruct a street or to tie in a street to another street, public
or private, in tile City of The Colony, that does not conform to the City's
Master Street and Thoroughfare Plan.
Section 3. No person, party, individual or corporation, either public or
private, including mnnicipal corporations, shall construct a street, either public
or private, in the City of The Colony without first obtaining a permit from the
City.
Section 4. Any person, party, individual, corporation, either public or
private, including municipal corporations, violating any of the provisions of this
ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof
shall be subject to a fine in a sum not to exceed One Thousand Dollars
($1,000.00) for each offense and a separate offense shall be deemed committed
upon each day dnring or on which a violation occurs.
Section 5. If any section, article, paragraph, sentence, clause, phrase or
word in this ordinance, or application thereto any person or circumstances is
held invalid or unconstitutional by a Court of competent jurisdiction, such
holding shall not affect thc validity of thc remaining portions of this ordinance;
and the City Council hereby declares it would have passed such remaining
portions of the ordinance despite such invalidity, which remaining portions shall
remain in full force and effect.'
Scetion 6. Thc fact that the present ordinances and regulations of the
City of The Colony, Texas, are inadequate to properly safeguard the health,
safety, morals, peace, and general welfare of the inhabitants of the City of The
Colony, Texas, creates an emergency for the immediate preservation of the
pnblic basiness, property, health, safety, and general welfare of the pablic which
requires that this ordinance become effective from and after the date of its
passage and it is accordingly so ordained.
