HomeMy WebLinkAboutOrdinance No. 514 CITY OF THE COLONY, TEXAS ORDINANCE NO. ~--/~ AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS AMENDING ORDINANCE NO. 214v PASSED AND APPROVED BY THE CITY COUNCIL ON THE 2ND DAY OF AUGUST, 1982, RELATING TO PROPERTY ZONED SC (SHOPPING CENTER), SUBJECT TO A SPECIFIC USE PERMIT FOR AN EATING PLACE WITH DRIVE- TROUGH SERVICE, (WHERE THE SALE OF BEER AMD WINE ARE SERVED INCIDENTAL TO THE SERVING OF FOOD); PROVIDING FOR AMENDMENT TO THE ZONING DISTRICT MAP; PROVIDING FOR PENALTY OF FINE NOT TO EXCEED THE SUM OF FIVE HUNDRED DOLLARS ($500.00) FOR EACH OFFENSE; AND PROVIDING AM EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: SECTION 1. That Section 1 of Ordinance No 214 passed and approved by the City Council of the City of The Colony, Texas on the 2nd day of August, 1982, be amended to read as follows: "That the Comprehensive Zoning Ordinance of the City of The Colony, Texas be, and the same is hereby, amended by amending the zoMing district map of the City of The Colony so as to change the following described property to "SC (Shopping Center) district classification, subject to a Specific Use Permit for an Eating Place with Drive-through Service (an establishment other than a bar, tavern or lounge where the primary activity is the sale and service of food to customers and where beer and wine are served incidental t the serving of food), said property being more particularly described as a building twenty four feet (24') x sixty feet (60'), located at Colony Square Shopping Center, 5201 S. Colony Blvd., Suite 700, The Colony, Texas, and known as Mr. W's Little Europe. SECTION 2. That Section 2 (e) of Ordinance No. 214 passed and approved by the City Council of the City of The Colony, Texas on the 2nd day of August, 1982, be amended to read as follows: "This Specific Use Permit shall be in effect in said location under the name of Mr. W's Little Europe, and will automatically terminate upon change of ownership. SECTION 3. That all ordinances of the City of The Colony in conflict with the provisions of this Ordinance be, and the same are hereby, repealed, and all other provisions of the City of The Colony, not in conflict with the provisions of this Ordinance shall remain in full force and effect. SECTION 4. Any person, firm or corporation violating any of the provisions or terms of this Ordinance shall be subject to the same penalty as provided for in the Comprehensive Zoning Ordinance of the City of The Colony, and upon conviction in the Municipal Court of the City of The Colony, Sha]]~ be punished by a fine not to exceed Five Hundred Dollars ($500.00) for each offense, and each and every day such offense shall continue shall be deemed to constitute a separate offense. SECTION 5. This Ordinance shall take effect immediately from and after its passage and the publication of the caption as the law and charter in such cases provide.
