RESOLUTION NO. 87-34
A RESOLUTION OF THE CITY OF THE COLONY, TEXAS,
AUTHORIZING AN AGREEMENT BETWEEN THE CITY
OF THE COLONY AND THE TEXAS DEPARTMENT OF
COMMUNITY AFFAIRS AND AUTHORIZING AN
AGREEMENT BETWEEN THE CITY OF THE COLONY
AND GOVERNMENTAL SERVICE AGENCY, INC.
WHEREAS, the City of Eastvale contracted with the Texas Department of Community
Affairs (Contract No. 706204 and attached hereto as Attachment 1) to perform certain planning
activities under the Texas Community Development Program Planning/Capacity Building Fund,
said activities being defined in Exhibit A, Performance Statement, of said contract and said
activities to be financially supported as outlined in Exhibit B, Project Budget, of said contract;
and
WHEREAS, the City of Eastvale has contracted with Governmental Service Agency, Inc.,
to perform the planning services as defined and described in Exhibit A, Performance Statement,
of TDCA Contract No. 706204; and
WHEREAS, the City of Eastvale has voted to consolidate with the City of The Colony
and said consolidation has occurred as of August 11, 1987; and
WHEREAS, certain activities defined in TDCA Contract No. 706204 with the City of
Eastvale have not been completed as of the date of consolidation of the City of Eastvale with the
City of The Colony; and
WHEREAS, the City of The Colony desires to complete the economic and industrial
development study, capital improvements program, and zoning ordinance as defined and
described in TDCA Contract No. 706204 and the amendment thereto and to assume the
obligations and responsibilities of said contract; and
WHEREAS, the City of The Colony has an existing subdivision ordinance which meets
the requirements defined and described in Exhibit A, Performance Statement, of TDCA Contract
No. 706204, and the City of The Colony will enforce the existing subdivision ordinance in all
areas of the City of The Colony including the area formerly known as the City of Eastvale which
is now part of The Colony; and
WHEREAS, the City of The Colony has previously incurred the costs associated with the
development and adoption of the existing subdivision ordinance, the local fund commitment of
$1,100.00 as described in Exhibit B, Project Budget, of TDCA Contract No. 706204, has already
been met; and
WHEREAS, the City of The Colony has an existing zoning ordinance which meets the
requirements described in Exhibit A, Performance Statement, of TDCA Contract No. 706204,
which the City of The Colony will enforce in all areas of the City of The Colony, including the
area formerly known as the City of Eastvale which is now part of The Colony; and
WHEREAS, the area formerly known as the City of Eastvale is not currently zoned in
accordance with the City of The Colony's existing Zoning Ordinance; and
WHEREAS, the City of The Colony is in need of a zoning map update to zone the area
of The Colony formerly known as the City of Eastvale, and the City of The Colony desires to
amend Exhibit A, Performance Statement, Section H. Zoning Ordinance Revision of TDCA
Contract No. 706204 to reflect the attached amendment (Attachment A to this resolution), which
deletes the zoning ordinance revision and amends the contract to revise and update the City of
The Colony's zoning map by including the area formerly known as the City of Eastvale and the
City of The Colony recognizes the four hundred dollar ($400.00) commitment of local funds for
the zoning update activity; and
WHEREAS, the City of The Colony desires to assume the obligations and responsibilities
of the contract between the City of Eastvale and Governmental Service AGency, Inc. to complete
the economic and industrial development study, capital improvements program and zoning map
update as defined and described in the amended Exhibit A, Performance Statement of TDCA
Contract No. 706204;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
THE COLONY, TEXAS, THAT:
SECTION 1.
The obligations and responsibilities of the City of Eastvale under the amended TDCA
Contract No. 706204 are hereby assumed by the City of The Colony.
SECTION 2.
The obligations and responsibilities of the City of Eastvale under the agreement between
the City of Eastvale and Governmental Service Agency relative to performance of
planning activities defined and described in the amended TDCA Contract No. 706204 are
hereby assumed by the City of The Colony.
SECTION 3.
The City Manager of the City of The Colony is hereby authorized to sign all documents
necessary to consummate the agreement between the Texas Department of Conununity
Affairs and the City of The Colony and the agreement between Governmental Service
AGency, Inc., and the City of The Colony.

H. ZONING ORDINANCE REVISION
1. The Zoning District Map shall be studied and recommendations made for the preparation
of a new Zoning District Map to include the area of the City of The Colony formerly
known as the City of Eastvale. Recommendations for zoning classifications and zoning
districts shall be assigned to the said area according to the zoning classifications del'reed
in the existing zoning ordinance of the City of The Colony.
4. A zoning report shall be prepared to include the revised map in a form suitable for
adoption following the Municipality's Attorney review of the technical material to be
presented to the Attorney.

H. ZONING ORDINANCE REVISION
1. The Contractor shall review, analyze, and make recommendations pertaining to the
existing Zoning Ordinance and Zoning District Map. Sections of the Ordinance that may
be inadequate in content or sections exhibiting difficulties in interpretation and
administration are to be studied.
2. Recommendations shall be prepared as additions, deletions, or corrections to specific
definitions, paragraphs, or sections to the zoning ordinance.
3. The Zoning District Map shall be studied and recommendations made by the preparation
of a new zoning District Map. Adjustments of zoning districts boundaries shall be
explained to clarify or recognize conflicts of districts with the Land Use Plan.
4. A zoning report shall be prepared to include the revised ordinance in a form suitable for
adoption following the Municipality's Attorney review of the technical material to be
presented to the Attomey. The revised Zoning District Map shall also be included in the
report.
