RESOLUTION NO.
A RESOLUTION IN OPPOSITION TO ANY LEGISLATION WHICH
WOULD LIMIT CITIES' ABILITY TO CONTROL BILLBOARDS;
PROVIDING FOR AN EFFECTIVE DATE UPON PASSAGE AND
APPROVAL.
WHEREAS, an important goal of all zoning and other police power
regulations of cities is the ability to bring property uses into compliance with
an overall plan for the good of the community; and
WHEREAS, the process of amortization of non-conforming uses ac-
complishes this purpose and is fair to the owner of such non-conforming uses and
taxpayers of cities; and
WHEREAS, the process of amortization of non-conforming uses is
constitutional, having been upheld by the highest courts of the land; and
WHEREAS, the billboard industry is attempting to convince the Texas
State Legislature to adopt legislation which would limit or abolish cities' ability
to control billboards through the use of reasonablle amortization schedules; and
WHEREAS, such legislation would single out the billboard industry for
treatment different and more favorable than all other land users in cities; and
WHEREAS, such legislation would hamper cities in their attempts to
control growth by a comprehensive plan for the good of the community and
would be costly to local citizens;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF THE COLONY, TEXAS:
SECTION 1. That by the passage of this Resolution the City of The
Colony, Texas, expresses its opposition to any legislation which would limit,
hamper or abolish cities' ability to control billboards by use of reasonable
amortization schedules.
SECTION 2. That a copy of this Resolution be sent to each of those
Representatives and Senators who represent the City of The Colony to wit:
Representative Jim Horn, Representative Ben Campbell, and Senator Bob
McFarland.
SECTION 3. That this Resolution shall be in full force and effect from
and after its passage and approval.
