HomeMy WebLinkAbout11/18/03 P&Z Planning and Zoning Commission November 18, 2003 MINUTES OF THE PLANNING AND ZONING COMMISSION MEETING HELD ON NOVEMBER 18, 2003 The Regular Session of the Planning and Zoning Commission of the City of The Colony, Texas was called to order at 6:30 p.m. on the 18th day of November, 2003 at City Hall with the following members present: Deville Hubbard, Chairman Bill Jamme DeWayne Snider Kirk Mikulec Brian Wade Absent: Bill Harrison - Business Staff: Harry Persand, Director of Development Services Chris Spencer, Planner James Hanvey, Staff Engineer Sandy Vondersaar, Administrative Assistant With five (5) P & Z members present, a quorum was established and the following items were addressed: 2.0 DISPOSITION OF MINUTES 2.1 Approval and/or correction of Planning and Zoning Commission Minutes for the meeting held on October 28, 2003. Motion to approve the minutes of the meeting held on October 28, 2003, Commissioner Jamme; second, Commissioner Wade. Motion carried 5-0. 3.0 CITIZEN INPUT None 4.0 PUBLIC HEARING -1- Planning and Zoning Commission November 18, 2003 4.1 Hold a public hearing and consider a request for amendment to the __ Comprehensive Zoning Ordinance of the City, the same being Appendix A - Zoning, of the City's Code of Ordinances, as amended, by amending Section 10-200, "Schedule of Uses", to allow for a "Golf Course" and "Country Club" in the Agriculture "A" Zoning District (2003-M030) Chairman Hubbard opened the public hearing at 6:31 p.m. Mr. Spencer presented the staff report regarding a request for amendment to the Comprehensive Zoning Ordinance of the City to allow for a Golf Course and Country Club in the Agriculture "A" Zoning District. Commissioner Jamme pointed out that the definitions of "Golf Course" and "Country Club" would not apply to The Tribute. Mr. Persaud responded that staff will review and make changes. Staff recommends approval. Chairman Hubbard closed the public heating 6:42 p.m. A motion for amendment to the Comprehensive Zoning Ordinance of the City, the same being Appendix A - Zoning, of the City's Code of Ordinances, as amended, by amending Section 10-200, "Schedule of Uses", to allow for a "Golf Course" and -- "Country Club" in the Agriculture "A" Zoning District (2003-M030), Commissioner Mikulec; second Commissioner Wade. Motion carried 5-0. 4.2 Hold a public hearing and consider a request for approval of a replat for Lot41R, Block 1, Garza Lake Estates, being a 0.413-acre tract situated in the G. Emberlin Survey, Abstract No. 394, located on the west side of Elm Street, south of the East Lake Highlands and north of Witt Road, in the City of The Colony, Denton County, Texas. (2003-RP007) Chairman Hubbard opened the public hearing at 6:43 p.m. Commissioner Snider recused himself due to conflict of interest. Mr. Spencer presented the staff report for approval ofa replat for Lot 41R, Block 1, Garza Lake Estates located on the west side of Elm Street, south of East Lake Highlands and north of Witt. Nineteen (19) notices were mailed to the property owners within 200 feet of the subject tract. No responses have been received. Mr. Steve Blethen of Lazerset Printing, 6700 Main Street, Suite 142, The Colony, Texas 75056, were present to answer questions. -2- Planning and Zoning Commission November 18, 2003 No one came forward to speak for or against this item. Staffrecommends approval with three (3) stipulations. Chairman Hubbard closed the public heating at 6:45 p.m. A motion to recommend approval of a replat for Lot 41R, Block 1, Garza Lake Estates, being a 0.413-acre tract situated in the G. Emberlin Survey, Abstract No. 394, located on the west side of Elm Street, south of the East Lake Highlands and north of Witt Road, in the City of The Colony, Denton Connty, Texas. (2003-RP007) subject to three (3) staff stipulations, Commissioner Jamme; second Commissioner Wade. Motion carried 5-0. 5.0 ITEMS FOR CONSIDERATION 5.1 Consider a request for approval of a Final Plat for Lot 1, Block A, Collonade Addition, being a 1.339-acre tract situated in the T. Wilson Survey, Abstract No. 1352, located at the northwest corner of Blair Oaks Drive and SIt 121, in the City of The Colony, Denton County, Texas. (2003-FP005) Mr. Spencer presented the staff report regarding a request for approval of a Final Plat for Lot 1, Block A, Collonade Addition located at the northwest comer of Blair Oaks Drive and SH 121. Mr. Eduardo Zambrana of Merriman Associates, 300 N. Field Street, Dallas, Texas 75202, was present to answer questions. Staff recommends approval with four (4) stipulations. A motion for approval of a l~nal Plat for Lot 1, Block A, Collonade Addition, being a 1.339-acre tract situated in the T. Wilson Survey, Abstract No. 1352, located at the northwest corner of Blair Oaks Drive and SIt 121, in the City of The Colony, Denton County, Texas. (2003-FP005) subject to four (4) staff stipulations, Commissioner Jamme; second Commissioner Wade. Motion carried 5-0. 5.2 Consider a request for approval of a Site Plan for Bank One, located on Lot 1, Block A, Colionade Addition, being a 1.339-acre tract situated in the T. Wilson Survey, Abstract No. 1352, located at the northwest corner of Blair Oaks Drive and SIt 121, in the City of The Colony, Denton Connty, Texas. (2003-SP012) Mr. Spencer presented the staff report regarding a request for approval of a Site Plan for Bank One, located at the northwest comer of Blair Oaks Drive and SH 121. Mr. Eduardo Zambrana of Merdman Associates, 300 N. Field Street, Dallas, Texas -3- Planning and Zoning Commission November 18, 2003 75202, was present to answer questions. _ Staff recommends approval with two (2) stipulations.
