HomeMy WebLinkAboutResolution No. 84-04 RESOLUTION NO. ~i~,q-C~ A RESOLUTION OF THE CITY OF THE COLONY, TEXAS, REQUESTING WORKERS' COMPENSATION INSURANCE COVERAGE FOR ELECTED OFFICIALS FROM THE TEXAS MUNICIPAL LEAGUE. WHEREAS, it is deemed advisable and desireable and timely to request from the Texas Municipal League Workers' Compensation Joint Insurance Fund that they provide coverage for Elected Officials while acting within the course and scope of their official duties; and WHEREAS, it is hereby officially found and determined that a case of emergency or urgent public necessity exists which requires the holding of the meeting at which this Resolution is passed, and that said meeting was open to the public, and public notice of the time, place and purpose of said meeting was given to all as required by Vernon's Ann. Civ. St. Article 6252-17. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: 1. The City of The Colony, Texas, of Denton County, Texas, hereby requests that the Texas Municipal League Workers' Compensation Joint Insurance Fund provide coverage for Elected Officials while they are acting within the course and scope of their duties. Elected Officials shall be covered by the Interlocal Agreement as any other employee of the City of The Colony, Texas. 2. That the City Manager is authorized and directed to do everything necessary and appropriate to provide Workers' Compensation Insurance Coverage for Elected Officials. ATTEST: JAN~/~ADD, -CITY SEC E ARY (SEAL) JPPLEMENT TO INTERLOCAL AGREEMENT TML WORKERS' COMPENSATION JOINT INSURANCE FUND' In cohsideration of the Employer Members' request for payment of additional benefits and in further consideration of the Fund's agreement to pay such benefits, the Intertocal Agreement is amended by adding thereto the applicable coverages: Volunteer Firemen and Police Reserves -- The Fund will pay on behalf of the Employer Member, if an employee within a public safety officer group of employees hereinafter described, shall sustain injury, including death resulting therefrom, under circumstances which would have rendered the Employer Member liable for compensation if the injured employee and the Employer Member had been subject to the Texas Workers' Compensation Law with respect to such employment, an amount equal to the compensation and other benefits which would have been payable under such law had the injured employee and the Employer Member been subject to such law with res'pect to such employment. The Dar-ties of this agreement do not by its '.;=~ intend to make applicable to themselves any provision of the Texas Worker~' Compensation Law not already in force and effect as to them. The reference to the Texas Workers' Compensation Law is intended as a measure and ex;ent of benefits and the liability therefore and not an adoption of the law. Etected Officials -- If a resolution of the governing body has been adopted providing coverage for elec:ed officials as required by law, such elected officials while acting within the course and scope of their official duties, shall be covered by the Interlocal Agreement as any other employee of the political subdivision. The Employer Member agrees to pay the premium for the payroll classifications checked below. Check entries made in headings -- Name and Contract No. -- and make corrections, if necessary. 3. Include any CETA payroll along with the regular payroll on the one premium worksheet form. 4. Estimated payroll is gross payroll excluding excess over $15,600 per employee and excluding surcharo.e ovedime on hourly employees. (DO NOT INCLUDE % FOR EMPLOYEES PAID 1¥~ TIMES HOURLY RATE FOR OVERTIME: ONLY .STRAIGHT TIME.) In addition to pay for time worked, payroll includes sick leave payment, bonuses, longevity pay, etc. .5. Payroll should be reported on all covered employees paid by the hour. day, week, month or year (including part-time). Compensation paid on a per meeting or per call basis should not be reported because the), legally are not considered employees for workers' compensation purposes. 6. For those cities having part-time or volunteer firemen who meet the legal definitio, n of employee (i e.. paid by the hour, day, week, month or year), the repo~able payroll for any such firemen must not be less than S5,200 per person per annum ($100 per week). 7. For those cities having volunteer public safety officers who do not meet the legal definition ol employee (i.e., paid by the hour, day, week, month or year) and who have elected to provide voluntary benefits to such volunteers, the reportable payroll for any such employee must not be less than S5,200 per person per annum ($1 O0 per week). This option requires an amendment to the Interlocal Agreement. (Contact TML of;ice for form.) 8. For those cities who have voluntarily taken required steps to cover elected offficia!sand declared that inten! with the Fund reportab e payroll must be actual but not less than S600 per person per annum. This option requires an amendment to the In~erlocal Agreement. (C;onlact TML office for form.) 9. For cities using fully containerized garbage collection equipment where the driver never has lo get ou! of the truck, all payroll of those employees exclusively involved in this type of work should be placed under class code 9404. For containerized collection where the driver has to get out of the cab to hook-up the container and for all other conventional collection techniques, place the payroll of these employees under class code 9403. 10. The number of $100 units of payroll is multiplied by the appropriate classification rate (eg., three firemen --Classification 7704 - Firemen - including drivers -- each making $1.5,000 annual salary would be computed as follows: 3 x 1.5,000 = $4.5,000 net payroll; divide by $100 = 4.50 units x 2..54 = Sl143 manual premium.) 11. Please total all columns and place the total number of employees and the tolal estimated payroll on the "TOTAL" line. 12. Place the total manual premium in box 1, and then complete box 3 and .5 according to the instructions listed in these boxes. .o 13. Minimum net estimated premium on line 5 must not be less than 5100. 14. Please sign and date the bottom line of the worksheet and return by October 15 to the TML Fund Office, 1020 Southwest Tower.
