HomeMy WebLinkAboutResolution No. 84-09 CITY OF THE COLONY, TEXAS RESOLUTION NO. _~'~q-aq A RESOLUTION AWARDING A CONTRACT FOR THE SALE OF A 13.606 ACRE TRACT OF LAND (SUBJECT PROPERTY) TO THE HIGHEST AND BEST BIDDER; AUTHORIZING AND DIRECTING THE CITY MANAGER TO ENTER INTO AND EXECUTE A CONTRACT FOR THE SALE OF SUBJECT PROPERTY IN A FORM TO BE APPROVED BY THE CITY ATTORNEY; PROVIDING A SEVERABILITY CLAUSE; AND DECLARING AN EMERGENCY. WHEREAS, pursuant to and in accordance with Tex. Rev. Civ. Stat. Ann. art. 5421c-12, the City Council on two separate occasions advertised for and solicited bids for the sale of Subject Property, all as fully and completely described in the Notices; and WHEREAS, no bids were received as a result of such advertisements which were satisfactory and acceptable; and WHEREAS, by Resolution No. 84-05 approved and accepted by the City Council on March 28, 1984, the City Manager was instructed and directed to seek bids (offers) on the sale of Subject Property; and WHEREAS, a committee composed of Janice Carroll, City Manager, Mayor Larry Sample and Councilmember Don Amick reviewed and analyzed bids (offers) received for sale of Subject Property all in accordance with the provisions of Resolution No. 84-05; and WHEREAS, the said committee has made its written recommendation to the City Council that the City Council award the contract for sale of Subject Property to -~'c~cL~ ~-~O... WHEREAS, the City i~s agreeable to entering into a contract for the sale of Subject Property with ~ ~~L~--~-'~ in a form to be approved by the City ~l~torney. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF THE COLONY: Section 1. That all of the matters in the preamble are found to be true and correct and are hereby incorporated into the body of this resolution as if copied in their entirety. Section 2. That the bid for Subject Property received byT~~o' -~o.~ ~.r~. ~q~.~. is hereby accepted. Section 3. That the City Council does hereby find, based on the above recited facts, that all competitive bidding requiren~ents of State law have been duly and reasonably satisfied and that the bid of(..~ l)cl-] for the sale of'Subject Property is the high~st and beSt bid and that the City does hereby award a contract to --[-~0~~ [ (~,~. ~_~ for the sale of Subject Property for the following amount:~ '' ' Section 4. That the City Council does hereby authorize, instruct and direct the City Manager to enter into and execute a contract for the sale of Subject Property with in a form approved by the City A~orney, anc~ to ta~e all necessary steps to effect the closing on Subject Property. Section 5. If any section, article, paragraph, sentence, clause, phrase or word in this resolution, or application thereto any person or circumstance is held invalid or unconstitutional by a Court of competent jurisdiction such holding shall not affect the validity of the remaining portions of the resolution; and the City Council hereby declares it would have passed such remaining portions of the resolution despite such invalidity, which remaining portions shall remain in full force and effect. Section 6. The fact that the present resolutions and regulations of the City of The Colony, Texas, are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the inhabitants of the City of The Colony, Texas, creates an emergency for the immediate preservation of public business, property, health, safety and general welfare of the public which requires that this resolution shall become effective from and after the date of its passage and it is accordingly so ordained.
