WHEREAS, the City Council of the City of The Colony, Texas, wishes to formally apply for a Department of the Army lease for twenty-five years for public park, athletic, and recreational purposes on Lake Lewisville Reservoir. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: That Janice Carroll, City Manager of the City of The Colony, Texas, be, and she is hereby, authorized and directed to execute and submit the attached application for a twenty-five year Depart- ment of the Army lease for public park, athletic, and recreational purposes on behalf of the City of The Colony, Texas, to the District Engineer, U. S. Army Engineer District, Fort Worth, P. O. Box 1600, Fort Worth, Texas, and to do such other and further acts, and to execute such additional instruments as may be necessary and proper to carry in force and effect the terms and provisions of such application and to enable the City or County to accept any lease granted as a result of said application and to fulfill any requirements made by the proper authorities with reference thereto. 1983. ATTEST: JAN~~E CARROLL, CITY SECRETARY AGREEMENT FOR FIRE PROTECTION SERVICES STATE OF TEXAS COUNTY OF DENTON CITY OF THE COLONY ~ement is made and entered into this /~?day of , 1983, by and between The Colony Volunteer Firefighters (the "Firefighters"), and the City of The Colony, (the "City"). In consideration of the mutual promises herein contained, the Firefighters and the City hereby expressly contract and agree as follows: 1. The Firefighters were established by Ordinance No. 48 of the City of The Colony, Texas. 2. The Firefighters agree to and shall continue to perform the functions provided in Ordinance No. 48. 3. The City shall pay to the Firefighters the sum of $5.00 per call for expenses, the same to be paid in one annual installment payable on ~~1~¢r of each calendar year for the expenses listed on Exhibit A attached hereto and incorporated herein by this reference. This agreement shall be interpreted and executed in accordance with the laws of the State of Texas and the charter and ordinances of the City and such portions of this agreement as may be contrary to public policy shall be void. This agreement may be cancelled or renegotiated by either party upon written notice to the other party, served upon the other party ninety (90) days prior to the next installment payment date.
