HomeMy WebLinkAbout10/28/03 P&Z Planning and Zoning Commission October 28, 2003 MINUTES OF THE PLANNING AND ZONING COMMISSION MEETING HELD ON OCTOBER 28, 2003 The Regular Session of the Planning and Zoning Commission of the City of The Colony, Texas was called to order at 6:30 p.m. on the 28th day of October, 2003 at City Hall with the following members present: Oeville Hubbard, Chairman Bill Jamme DeWayne Snlder Kirk Mikulec Brian Wade Absent: Bill Harrison ~ Business Staff: Harry Persaud, Director of Development Services Chris Spencer, Planner James Hanvey, Staff Engineer David Berman, City Attorney Sandy Vondersaar, Administrative Assistant With five (5) P & Z members present, a quorum was established and the following items were addressed: Mr. Persaud introduced City Attorney David Berman. 2.0 DISPOSITION OF MINUTES 2.1 Approval and/or correction of Planning and Zoning Commission Minutes for the meeting held on October 14, 2003. Motion to approve the minutes of the meeting held on October 14, 2003, Commissioner Jamme; second, Commissioner Wade. Motion carried 5-0. 3.0 CITIZEN INPUT None -1- Planning and Zoning Commission October 28, 2003 4.0 PUBLIC HEARING 4.1 Hold a public hearing and consider a request for approval of an amendment to the development plan for Planned Development "PD-11" regarding approximately 17.745-acres situated north of SH 121, east of Main Street, south of Memorial Drive and west of Blair Oaks Drive, in the City of The Colony, Denton County, Texas. (2003oZ001) Chairman Hubbard opened the public heating at 6:36 p.m. Mr. Spencer presented the staff report regarding approval of an amendment to the development plan for Planned Development "PD-11" located north of State Highway 121, east of Main Street, south of Memorial Drive and west of Blair Oaks Drive. Twenty-two (22) notices were mailed to the property owners within 200 feet of the subject tract. None were returned. Mr. Dale Gates of Development Resources, Inc., 14860 Montfort Drive, Suite 205, Dallas, Texas 75254, representative of the property owner, was present to answer questions. Mr. Rob Farrell of Robert M. Farrell, Properties , 8235 Douglas Avenue, Suite 950, -- Dallas, Texas 75225-6017, requested this item be tabled until after the scheduled conference call with himself, City staff, Albertson's attorney Mr. Rich Burleigh and the adjacent property owners. City Attorney Berman explained mutual access is a public safety issue and is in the best interests of the community. In his opinion the conference call would not change the outcome regarding approval of this item by the Commission. Staff recommends approval subject to five (5) stipulations. Chairman Hubbard closed the public heating 7:20 p.m. A motion for approval of an amendment to the development plan for Planned Development "PD-11" regarding approximately 17.745-acres situated north of SH 121, east of Main Street, south of Memorial Drive and west of Blair Oaks Drive, in the City of The Colony, Denton County, Texas (2003-Z001) subject to five (5) staff stipulations, Commissioner Jamme; second Commissioner Snider. Motion carried 5-0. 4.2 Hold a public hearing and consider making a recommendation regarding a __ request for a change in zoning from General Retail "GR" zoning district classification to Heavy Commercial "HC" zoning district classification on a -2- Planning and Zoning Commission October 28, 2003 tract of 0.276 acres situated in the G. Emberlin Survey Abstract #394, located on the west side of Elm Street, south of the East Lake Highlands and north of Witt Road, in the City of The Colony, Denton County, Texas. (2003- Z002) Chairman Hubbard opened the public heating at 7:20 p.m. Commissioner Snider reeused himself due to conflict of interest. Mr. Spencer presented the staff report to consider making a recommendation regarding a request for a change in zoning from General Retail "GR" zoning district classification to Heavy Commercial "HC" zoning district located on the west side of Elm Street, south of East Lake Highlands and north of Witt. Twenty (20) notices were mailed to the property owners within 200 feet of the subject tract. One (1) was returned in favor. Mr. and Mrs. Steve Blethen of Lazerset Printing, 6700 Main Street, Suite 142, The Colony, Texas 75056 were present to answer questions. No one came forward to speak for or against this item. Staff recommends approval. Chairman Hubbard closed the public hearing at 7:38 p.m. A motion to recommend approval of the zoning change for lots 45 and 46 from Heavy Commercial "HC' to General Retail "GR" located on the west side of Elm Street, south of the East Lake Highlands and north of Witt Road, in the City of The Colony, Denton County, Texas. (2003-Z002) Commissioner Jamme; second Commissioner Wade. Motion carried 3-1. Commissioners Jamme, Wade and Hubbard for; Commissioner Mikulec against.
