HomeMy WebLinkAboutResolution No. 04-66 RESOLUTION NO. 04-66 A RESOLUTION EXPRESSING THE CONCURRENCE OF THE GOVERNING BODY OF THE CITY OF THE COLONY IN THE DECISION OF THE AFFECTED PARTIES TO CONSTRUCT STATE HIGHWAY 121 AS AN ELECTRONIC TOLL FACILITY (PROJECT: CSJ 0364-03-066, WITHIN THE CONFINES OF THE MUNICIPAL LIMITS), ACKNOWLED1NG THE REALLOCATION OF STATE, REGIONAL AND LOCAL FUNDING TO PROVIDE FOR NON TOLLED ALTERNATiVES AND REGIONAL MOBILITY PROJECTS OF BENEFIT TO THE COLONY; AND, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, efficient non-congested transportation in the region is a necessary component for economic growth, air quality, safety and quality of life; and WHEREAS, nearly 90,000 vehicles are added annually to the streets and highways of the Dallas-Fort Worth Transportation Management Area (Region); and WHEREAS, the metropolitan area is the ninth largest metropolitan area in the country and is expected to grow by one million persons each decade, which by 2025 is a 75% increase over 1999 and modeled travel in the region will increase by 87%; and WItEREAS, the Texas Metropolitan Mobility Plan prepared by the North Central Texas Council of Governments and approved by the Surface Transportation Technical Committee has identified funding needs of $100 billion for the region through the 2025 planning horizon, with funded resources of $45 billion leaving a deficit or unfunded transportation mobility needs in excess of $55 billion; and WHEREAS, the construction of State Highway 121 and State Highway 161 as electronic toll facilities are projected to be self-supporting and an add significant transportation revenue to the region which will allow the Texas Transportation Commission to earmark Strategic Priority Funding to the region; and WHEREAS, as a result of the construction of State Highway 121 as an electronic toll facility, the Metropolitan Planning Organization for the region recommends equitable reallocation of federal and state funding to the entities specifically impacted by the facility, including: Denton County, The Colony, Lewisville, Carrollton, Coppell, Frisco, Plano and Grapevine (affected parties); and WltEREAS, a Memorandum of Understanding identifying the funds to be reallocated, including federal, state and local funds, is in final draft acknowledging the rights, responsibilities and obligations by and between the parties; and WHEREAS, subsequent to approval of the memorandum of understanding between the affected parties, the City of The Colony will receive funding reallocations totaling $18.25 million for local projects which will be funded by Denton County through defederalization of its regional commitments, a TxDOT commitment to fund FM 423 construction and the refund of the municipalities' State Infrastructure Bank loan payments; and WEIEREAS, the approval, funding and construction of these projects will improve the transportation mobility, lessen congestion, approve air quality, and facilitate economic development for citizens in the project affected area. NOW THEREFORE BE IT RESOLVED by the City Council of the City of The Colony: SECTION 1. AUTHORITY The Mayor, or Mayor's designee, is hereby authorized and directed to implement the applicable provisions of this Resolution. SECTION 2. CONCURRENCE The governing body of the City of The Colony does hereby concur in the decision of the affected parties to support the construction of State Highway 121 as an electronic toll facility within the project limits. SECTION 3. CONTINGENCY Approval and concurrence of the governing body is specifically contingent upon the approval by the Regional Transportation Council and the Texas Transportation Commission of the Memorandum of Understanding referenced herein between the affected parties as finally ratified by the City and the enforceable financial commitments to the projects identified therein, in the manner specified. SECTION 4. NOTICE The City Manager is instructed to convey to the Regional Transportation Council and through them to the Texas Transportation Commission an official copy of this Resolution when adopted. SECTION 6. EFFECTIVE DATE This Resolution shall take effect fi.om and after the date of its adoption. PASSED AND APPROVED this 13th day of September, 2004. ATTEST: City Secretary/Clerk ~ty Attorney
