A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF THE
COLONY, TEXAS, APPROVING THE CHANGE ORDERFOR THE
ENGINEERING SERVICES CONTRACT BY AND BETWEEN THE CITY
OF THE COLONY AND HALFF ASSOCIATES FOR A FINAL PLAT
FOR MEMORIAL PARK, PAIGE ROAD ADDITIONAL WORK, AND
TRAFFIC SIGNAL DESIGN FOR PAIGE/MEMORIAL INTERSECTION,
WHICH IS ATTACHED HERETO AND INCORPORATED HEREIN AS
EXHIBIT "A"; AUTHORIZING THE CITY MANAGER TO EXECUTE
THE CONTRACT; AND PROVIDING AN EFFECTIVE DATE
WHEREAS, the City and Consultant have entered into an agreement such that the
Consultant is to provide the following services: A FINAL PLAT FOR MEMORIAL PARK,
PAIGE ROAD ADDITIONAL WORK, AND TRAFFIC SIGNAL DESIGN FOR
PAIGE/MEMORIAL INTERSECTION; and
WHEREAS, the City has determined that it is in the best interest of the City to enter into
the Contract with HALFF ASSOCIATES, which is attached hereto and incorporated herein by
reference as Exhibit "A," under the terms and conditions provided therein.
WHEREAS, with this Change Order the City of The Colony is agreeing to pay the sum
not to exceed $32,500.00 for such work.
THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
THE COLONY, TEXAS THAT:
Section 1. The CHANGE ORDER, which is attached and incorporated hereto as Exhibit
"A", having been reviewed by the City Council of the City of The Colony, Texas, and found to be
acceptable and in the best interest of the City and its citizens, be, and the same is hereby, in all
things approved, and the City Manager is hereby authorized to execute the Agreement on behalf of
the City of The Colony, Texas.
Section 2. That this Resolution shall take effect immediately from and after its adoption
and it is so resolved.

EXHIBIT "A"
ADDITIONAL SERVICES
For
Site Infrastructure Associated with Horizon Water Park
In
THE COLONY
I. De~criptiun
The Additional Services are for three separate tasks:
A. Prepare a Final Plat for the Memorial Park Site, currently known as Five Star
Park East, that will supersede the current Memorial Park Site Conveyance Plat
that was filed for record in Cabinet Q, Page 161 of the Plat Records of Dentun
County, Texas on May 24, 1999. A Final Plat is required for the construction of
Hawaiian Falls Water Park and the Site Infrastructure associated with it.
B. Paige Road requires an additional outside 12-foot lane along the west side of the
road for southbound traffic between Memorial Drive and State Highway 121
(SH 121). The outside lane will extend the existing SH 121 right turn lane up to
the Paige Road / Memorial Drive Intersection. The remainder of the Paige Road
/ Memorial Drive Intersection west of Paige Road will be designed. Two 12~foot
lanes, a 12~foot left turn lane with 150-feet of storage, and an asphalt transition
will be added to the intersection. See attached Figure 1. The Phase II plans will
be amended to include the additional lane on Paige Road and the Paige Road /
Memorial Drive intersection.
C. Traffic Signal Design at the Intersection of Paige Road and Memorial Drive.
The current Traffic Signal Design by Hunter Associates Texas, Ltd., is
insufficient due to the as-built conditions and proposed design of the Paige Road
and Memorial Drive Intersection. The Phase II plans will be amended to include
the Traffic Signal Design at the Intersection of Paige Road and Memorial Drive.
II. Work Plan
A. Final Plat for Memorial Park Site (Five Star Park East) - Preparation of the
Final Plat will require the following field and office work:
1. Prepare plat application and calculate the new property boundary and
existing/proposed easements within boundary.
2. Draft the property boundary and easements within the boundary.
3. Attend Development Review Committee (DRC) Meeting on April 15, 2004.

4. Attend Planning and Zoning Commission Regular Meeting on April 27,
2004.
5. Stake comers for the proposed boundary after Final Plat has been approved
by the City.
~inal Plat Deliverables shall include:
1. Fifteen (15) folded 18" x 24" copies of the Final Plat for Development
Review Committee (DRC) review on April 8, 2004 by 10:00 a.m.
2. Ten (10) folded 18" x 24" copies of the Final Plat, one (1) 8 ¼" x 11" copy,
and one (1) 11" x 17" copy after the Development Review Committee on
April 21, 2004.
3. Digital file in a *.dxffile format of the final plat.
B. Paige Road Additional Work - Halff will add additional information to the
Phase II construction plans and specifications for the additional lane on Paige
Road and the Paige Road / Memorial Drive intersection. Additional information
added to the plans will include the following:
o Paige Road Plan and Profile
o Paige Road Typical Paving Sections
o Paige Road Pavement Markings
o Erosion Control
o Temporary Traffic Control
o Roadway Cross-Sections
C. Traffi~ _ The design will be based on TxDOT Guidelines for
traffic signal installation and in accordance with TxDOT Standard
Specifications for Traffic Signals. The proposed signal installation plan will
include:
1. Signal Layout Plan showing the location of equipment, detection system
and signal controller, and signal phasing plan.
2. Signal Operation Plan showing Signal Wiring Chart, Mast Ann Schedule,
Signal Head Table, Conduit and Cable Run, and Sign Summary.
3. A Summary Sheet of Quantities showing Item Number, Description, Units,
and Quantities.
4. Standard TxDOT Specifications and Special Specifications Sheets.

5. Probable Cost of Construction of the Traffic Signal.
6. Bid Document for the Installation of the Traffic Signal.
D. Su lemental Suave s - Additional field survey work will be performed to
, obtain the "as-built" elevations for the north half of Memorial Drive (currently
under construction) and the intersection of Paige Road and Memorial Drive that
may affect the design.
E. Subsurface Utility Location - Halff will locate the depth of an existing 18-inch
TXU pipehne to verify clearance from the existing ground to the top of pipe.
This information will be used in the design of Memorial Drive.
III. Schedule
A. Final Plat for Memorial Park Site (Five Star Park East) - Halff has akeady
begun work on the Final Plat and will adhere to the following schedule:
Application and Final Plat (Review) April 8, 2004
Development Review Committee (DRC) April 15, 2004
Planning and Zoning Commission Regular Meeting April 27, 2004
B. J~aige Road Additional Work - Halff will begin work immediately after receipt
of written notice to proceed and in accordance to the following project
milestones:
Complete Final Phase II Plans
May 21, 2004
Complete Bid and Award July 1, 2004
Complete Construction March 1, 2005
The schedule above is a modification of the Horizon Water Park Phase II schedule.

EXHIBIT "B"
BASIS OF COMPENSATION
for
Site Infrastructure Associated with Horizon Water Park
in
THE COLONY
Exhibit defines the basis of compensation to the Consultant for the services rendered.
Final Plat for Memorial Park Site (Five Star Park East) Servict
The basic fee for the services as described in Exhibit "A" will be $5,000 which includes
office work, field work, meetings, and deliverables.
Halff A~ssociates prepared Amendment No. 1 to the Engineering Agreement for "Site
Infrastructure Associated with Horizon Water Park to provide drainage and electrical
easements (Additional fee Item No. 1) on March 15, 2004. Amendment No. 1 has been
approved by the City of the Colony. A basic fee of $3,000 was agreed upon to complete
the legal descriptions for the easements and stake the easement in the field. A basic fee
of $1,200 is still required to stake the easements. However, the portion of the fee required
to complete the legal descriptions is no longer applicable since the Final Plat will
describe the easements. Therefore, the fee for the Legal Descriptions, a total of $1,800,
has been deducted from the basic fee for the Final Plat.
The basic fee was calculated in the following manner:
Basic Fee for the Final Plat: $6,800
Basic Fee for Legal Descriptions (deduction) -$1,800
Basic Fee:
$5,000
The basis of compensation for Basic Fee services shall be as follows:
* $5,000 upon the submittal of the Final Approved Plat with signatures.
The total maximum fee for Final Plat for Memorial Park Services is $5,000.
Paige Road Additional Work Services
The basic fee for the services as described in Exhibit "A" will be $11,500 which includes
additional engineering to amend the Phase II plans to include an additional lane on Paige
Road and the Paige Road/Memorial Drive intersection.
The basis of compensation for Basic Fee services shall be as follows:

* $11,500 f°r Final Plans, Specifications, and Estimates
The total maximum fee for the Paige Road Additional Work Services is $11,500.
Traffic Signal Design Services
The basic fee for the services as described in Exhibit "A" will be $12,000 which includes
additional engineering to amend the Phase II plans to include the Traffic Signal Design at
the Intersection of Paige Road and Memorial Drive.
The basis of compensation for Basic Fee services shall be as follows:
· $8,500 for Final Plans, Specifications, and Estimates
· $3,500 for Construction Administration
The total maximum fee for the Traffic Signal Design Services is $12,000.
Soecial Services
The special services fee for the services as described in Exhibit "A" will be .$4,000 which
includes the supplemental design surveys for the design of the Intersection of the Paige
Road and Memorial Drive Intersection and a Subsurface Utility Location.
The basis of compensation for Special Services shall be as follows:
· $2,500 for Supplemental Design Surveys
· $1'500 f°r Subsurface Utility Location (to determine existing location of
TXU Pipeline)
The total maximum fee for Special Services is $4,000.
The total maximum fee for the Final Plat for Memorial Park, Paige Road Additional
Work, Traffic Signal Design, and Special Services is $32,500.
Items will be billed lump sum upon completion of each task.
All work will be billed to Phase II. The total fee for Phase II will increase from $I 11,500
to $144,000. The total fee for the entire contract will increase from $219,500 to
$252,000.
