A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF THE
COLONY, TEXAS, APPROVING THE TERMS AND CONDITIONS OF
THE ENGINEERING SERVICES CONTRACT BY AND BETWEEN THE
CITY OF THE COLONY AND FREESE AND NICHOLS, INC. FOR
ANALYSIS OF ROUTING OPTIONS FOR WASTEWATER FROM
AUSTIN RANCH TO THE STEWART CREEK TREATMENT PLANT,
WHICH IS ATTACHED HERETO AND INCORPORATED HEREIN AS
EXHIBIT "A"; AUTHORIZING THE CITY MANAGER TO EXECUTE
THE CONTRACT; AND PROVIDING AN EFFECTIVE DATE
WHEREAS, the City and Consultant have entered into an agreement such that the
Consultant is to provide the following services: ANALYSIS OF ROUTING OPTIONS FOR
WASTEWATER FROM AUSTIN RANCH TO THE STEWART CREEK TREATMENT
PLANT; and
WHEREAS, the City has determined that it is in the best interest of the City to enter into
the Contract with FREESE AND NICHOLS, INC., which is attached hereto and incorporated
herein by reference as Exhibit "A," under the terms and conditions provided therein.
WHEREAS, with this Contract the City of The Colony is agreeing to pay a sum not to
exceed $17,535.00 for such work.
THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
THE COLONY, TEXAS THAT:
Section 1. The Engineering Services Contract, which is attached and incorporated hereto as
Exhibit "A", having been reviewed by the City Council of the City of The Colony, Texas, and found
to be acceptable and in the best interest of the City and its citizens, be, and the same is hereby, in all
things approved, and the City Manager is hereby authorized to execute the Agreement on behalf of
the City of The Colony, Texas.
Section 2. That this Resolution shall take effect immediately from and after its adoption
and it is so resolved.

SCOPE OF SI~RVICES - TASK ORDER NO. $
BASIC SERVICES: FNI shall render the following professional services in connection
with the development of this Task Order:
TASK DESCRIlq~ONS
Task 1 - Routing Development
The City of The Colony needs an alignment developed for thc routing of the Austin
Ranch sewage force main to The Colony Stewart Creek Plant..
1. Develop a property ownership map detailing the owners and property boundaries
along the general routing from the Austin Ranch lift station site developed in the
August 2003 Wastewater Service Alternatives Evaluation to The Colony Stewax~
Creek treatment plant.
o~ Perform a routing analysis accounting for property ownership boundaries,
city limlt boundaries, TX. DOT requirements for crossing SHI21, and
existing large diameter gravity flow pipelines crossing the general corridor
to the plant
b. Prepare existing capacity availability in two gravity flow mains to be
considered for discharge points fi~m thc Austin Ranch ~ station, using
per capita flows developed in the Previous report and as-built plans for thc
two gravity lines being cousidered (provided by the City).
c. Mcct with ~¢ Austin Ranch Developer to discuss thc options.

e. Meet with thc City to icview the rccommend.ations. Incorporate commctits
and issue a final report.

FNI will perfon-a these services in accordance with the requirements of the original
Agreement for Irofessinna] Services dated November 20, 2001.
Task 1.1 Project Admlai~-afion
FNI will perform general administrative duties associated with thc Projeet including
progress monitoring, scheduling, general correspondence, office administration, and
Invoicing. These duties include day-to-day contact and liaison with the oWNER and
project staft~ providing a one-page weekly report on progress;ensuring thc needa of the
OWNER are met in a timely mannex;, providing project communication; and mOnitoring
work on the project.
Task 1.2 Project Meeting and Workshops
Three project status/coordination meetings will be scheduled and held in the City of The
C~.lony municipal offices to coordinate evaluation details and alternatives with the City
and other consultants.
RESPONSIBILITIES OF OWNER: OWNER shall perform the following in a timely
manner so as not to delay the services of FNI:
I. Designate in writing a person to act as OWNER's representative with respect to
the services to be rendered under this Task Order.
2. Provide copies of as-built drawings for existing mains ahd lift stations to be
considered in the analysis for the Anstin Ranch flow discharge.
3. Provide all criteria and full information as to OWNER's requirements for thc
Project, including objectives and constraints, space, capacity and Performance
requirements, flexibility and expendability, and any budgetary limitations.
4. Assist FNI by placing at FNI's disposal all available information pertinent to the
Project including previous reports and any other data relative to design or
construction of the Projeat.
5. Examinc all studies, reports, sketches, drawings: specifications~ prqposals and
other documents present-ed by FNi within a reasonable time so as not to delay thc
services of FNI.
COMPENSATION: The total fee for this Task Orcler shall be computed on thc basis of
the original Schedule of Cha~'ges but shall not exceed $16,700. IfFNI sees the Scope of
Services changing so that Additional Services arc needed, FNI will notify OWNER for
OWNER's approval before proceeding. Additional sea-viees shall be computed based on
the Schedule of Chargcs.
Compensation shall be as indicated below:
Investigation - compensation shall be the lump sum of $16,700.
