HomeMy WebLinkAboutResolution No. 04-07 Resolution No. E?/4- D'~'/ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS, APPROVING AN AMENDMENT TO SECTION 2.22 OF A CONTRACT WITH WASTE MANAGEMENT INC. TO PROVIDE A SECOND RECYCLING CART TO CITY RESIDENTS UPON REQUEST; PROVIDING FOR AN AMENDMENT TO THE RESIDENTIAL RATE FOR RECYCLING SERVICES OF $1.38 PER MONTH FOR EACH RECYLCING CART; AUTHORIZING THE CITY MANAGER TO EXECUTE THE APPROPRIATE DOCUMENTS; PROVIDING A REPEALER CLAUSE; AND PROVIDING AN EFFECTIVE DATE WHEREAS, the City of The Colony entered into a contract with Waste Management Inc. for solid waste collection for Commercial and Industrial Collection, Transport, DisposaI and Residential and Multi-Family Recycling Agreement; and WHEREAS, Waste Management Inc. has agreed to provide the City with additional recycling carts for distribution to City residents upon their request; and WHEREAS, the City Council desires to amend the Contract to provide for the ability to distribute a second recycling cart for an additional of cost of one dollar and thirty-eight cents ($1.38) to be billed to the resident. THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS THAT: Section 1. The City Council hereby approves the amendment to Section 2.22 of the Contract with Waste Management Inc. to provide a second recycle cart to the City residents upon request, which shall read as follows: "2.22 If requested by a City resident, a second recycle cart will be supplied as requested at no cost to the City." Section 2. That the City Council hereby approves the amendment to the residential rate for recycling services, which shall read as follows: "$1.38 per month for each recycle cart" Section 3. That the City Manager is hereby authorized to execute all appropriate documents to amend the contract to reflect the changes provided for herein. Section 4. That all provisions of any resolution of the City Council of the City of The Colony in conflict with the provisions of this resolution be, and the same are hereby, repealed, and all other provisions not in conflict with the provisions of this resolution shall remain in full force and effect. 58692 PASSED, APPROVED and EFFECTWE this / day of March, 2004.
