A RESOLUTION OF THE CITY OF THE COLONY, TEXAS,
AUTHORIZING THE MAYOR TO EXECUTE AN INTERLOCAL
COOPERATION AGREEMENT BETWEEN THE CITY AND LEWlSVILLE
INDEPENDENT SCHOOL DISTRICT TO PROVIDE FOR A SCHOOL
RESOURCE OFFICER AT THE COLONY HIGH SCHOOL FOR THE 2003-
2004 SCHOOL YEAR; PROVIDING AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF THE COLONY, TEXAS:
Section 1. That the mayor is hereby authorized to execute an Interlocal cooperation
agreement between the City and Lewisville Independent School District to provide for a school
resource officer at Thc Colony High School for the 2003-2004 school year as defined in the
Agreement.
Section 2. That a true and correct copy of the Interlocal Cooperation Agreement is
attached hereto and incorporated herein.
Section 3. That this resolution shall take effect immediately fi.om and after its passage.

INTERLOCAL AGREEMENT
This Agreement is made and entered into on the 9th day of June by and between
the City of The Colony and the Lewisville Independent School District.
WHEREAS, the City of The Colony and Lewisville Independent School District
wish to enter in to this Agreement to establish one (1) School Resource Officer into The
Colony High School.
NOW, THEREFORE, under the authority of the Texas Government Code,
Chapter 791, entitled "Interlocal Cooperation Act," the City of The Colony and
Lewisville Independent School District for the mutual consideration herinae~er stated,
agree and contract as follows:
I. Effective Date: The effective date of this Agreement shall be on the l0th day of
June.
II. Term: The initial term of this Agreement shall be for the period from September
1, 2003 through August 31, 2005. This Agreement shall automatically renew for
periods of twenty-four (24) month increments from the initial termination date
unless written notice of intent to terminate the Agreement is given by either party
ninety (90) days in advance of termination.
III. Use of School Resource Officers: The City of The Colony agrees to provide
the Lewisville Independent School District with one (1) School Resource Officer to
be assigned to The Colony High School, 4301 Blair Oaks, The Colony, Texas. This
Officer shall be present at the above-mentioned school during school hours,
Monday through Friday, excluding holidays, in-service training days and authorized
breaks, and Christmas, Spring and Summer vacations.
IV. Expenditures: The City of The Colony and Lewisville Independent School
District agree to enter into this Agreement on a shared cost basis, the City of The
Colony agreeing to pay on half (1/2) of the officer's yearly salary and the
Lewisville Independent School District agreeing to pay on half (1/2) oftbe officer's
yearly salary. The Lewisville Independent School District shall bear no other
expenditures. The parties acknowledge that Lewisville Independent School District
or the City of the Colony's expenditures related to this Agreement shall not exceed
$27,114 in the 2003-2004 school year. See Exhibit A.
V. Supervision/Accountability: The School Resource Officer shall be supervised,
evaluated, disciplined, and under the control of the Chief of Police for the City of
The Colony at all times.
VI. Liability: Neither party shall make any claim against the other, and neither
party shall be liable to the other, for any actual or alleged negligence or losses
suffers y the other or a third party, however caused. This shall apply to all cases of
negligence of either party, their respective officers, employees, agents or otherwise.
VII. Entire Agreement: This Agreement embodies the whole agreement of the
parties. There are no promises, terms, conditions, or obligations other that those
contained, or referenced herein. This Agreement shall supersede all previous
communications, representations, or agreements, either verbal or written, between
the parties, and all modifications of this Agreement shall be in writing approved by
both parties.
VIII. Severability: In case any one or more of the provisions contained in the
Agreement shall be held to be invalid, illegal or unenforceable in any respect, such
invalidity, illegality or unenforceability shall not affect any other provision thereof
and this Agreement shall be construed as if such invalid, illegal or unenforceable
provision had never been contained herein.

Dear Sir:
Per our telephone conversation, you requested the cost of keeping the School
Resource Officer in The Colony High School during the 2003-2004 school year.
As you indicated, you were already paying related expenses in the Cities of
Lewlsvllle, Carrollton, and Flower Mound for this service and wish to extend the
same courtesy now to The Colony.
~low are the annual costs associated with thi~ position. They are assigned to
The Colony High School for approximately 9 I/2 months out of the year. Typically
when school is out, is when the officer schedules vacations and training schools.
The cost does not indude cost for training, uniforms, vehicle and equipment
expense. The two-year salary step is reflecUve of the minimum salary that
would be paid to anyone assigned to flqe School Resource Officer position.
Officer Fltzpatrick's salary, the current SRO, is in brackebs.
