NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: Section 1. That a change order in the amount of $36,500 to the engineering services agreement with Nathan D. Maier Consulting Engineers for the incorporation of Office Creek Phases IIA & B is hereby accepted. Section 2. That a tree and correct copy of the Change Order is attached hereto and incorporated herein. Section 3. That this resolution shall take effect immediately from and after its passage. City Engineer City of The Colony 6800 Main Street The Colony, Texas 75056 RE: Memorial Drive Improvements Blair Oaks Drive to Paige Road (3400' +/-) Contract Amendment Dear Mr. Saldana: Nathan D. Maier Consulting Engineers, Inc. (NDMCE) is pleased to present this proposal to amend the agreement for engineering and surveying services for the Memorial Drive Improvements. UNDERSTANDING OF THE PROJECT Memorial Drive is proposed to be a six-lane divided urban arterial with curb and gutter, raised median and an enclosed storm sewer system within a 100' right-of-way. The design of this project was essentially complete when the project scope was modified. The burrent project is proposed to design and construct the northern two lanes of the ultimate six-lane street. This includes survey and hydraulic analysis to accommodate the ultimate roadway project. The roadway design has been modified to construct the northern two lanes with gabions along the natural channel of Office Creek and a temporary earth retaining wall along the south right-of- way line (future centerline). If the City is successful in obtaining a slope easement from the adjacent property owner, the temporary earth retaining wall will be deleted and a 4:1 side slope will be used. The water line has been relocated from the north parkway to the median as instructed by the City. There are two separate projects underway to construct a channel for Office Creek along the north side of Memorial Drive from Paige Road to a point west of Blair Oaks Drive. Memorial Drive will be parallel to and adjacent to the channel. The City wishes to combine the three projects into a single construction contract. The City has instructed NDMCE to investigate the feasibility of redirecting the channel from SH 121 to a location adjacent to and parallel to Blair Oaks Drive and upsizing the culvert to handle the redirected flow. In the original project scope, there are two major creek crossings included in the Memorial Drive project. Two NorthPark / 8080 Park Lane I Suite 600 ! Dallas, Texas 75231 ! Paving and Drainage Engineering Design NDMCE will modify the original engineering design and prepare construction plans for Memorial Drive from Blair Oaks Drive to Paige Road. The project design will be modified to delete the southern half of the roadway from the final construction plans and to include a temporary earth retaining wall along the south right-of-way line so as not to encroach on the adjacent property. If the City is successful in obtaining a slope easement from the adjacent property owner, the temporary earth retaining wall will be deleted and a 4:1 side slope will be used. The roadway cross sections will be modified to reflect the current design. The culvert design nearest to Blair Oaks Drive will be upsizedto handle the flow from the relocated SH 121 channel. 2. Project Manual NDMCE will prepare the project manual and contract documents for Memorial Drive from Blair Oaks Drive to Paige Road. The project will combine Memorial Drive and the two Office Creek projects for bid and construction purposes. The City Will provide construction plans and specifications for the Office Creek project being designed by Kimley-Horn for inclusion in the contract documents. The contract documents will utilize NCTCOG standard specifications or other standards specified by the City. 3. Geoteehnieal Investigation NDMCE will provide geoteehnieal investigation services through a subeonsultant. The geoteelmieal investigation will provide data to be used in design of the gabion retaining wall and preparation of pavement subgrade. COMPENSATION NDMCE proposes to accomplish the above services for a fixed fee as listed below. Modify Paving and Drainage Engineering Design $ 26,500.00 Prepare Contract Documents $ 3,500.00 Water Line Engineering Design $ 6.500.00 TOTAL AMENDED BASIC SERVICES $36,500.00 Reimbursable expenses, including reproduction, mileage and deliveries will be billed at the rate of actual cost plus 15%. Any services requested but not defined in the scope of services above Mr. Gordon Scruggs, P.E. February 24, 2003 Page 3 will be performed on an hourly basis or an agreed lump sum fee. Hourly items will be billed in accordance with our schedule of fees and charges in Attachment "A". PAYMENT Invoices for services outlined in this proposal will be submitted, with supporting information as appropriate, on the first day of each month and are due within 30 days of receipt. TERMINATION OF SERVICES In connection with the services to be provided to you by NDMCE, we agree that you may cancel or indefinitely suspend further work or terminate this agreement, or any portion of it, upon written notice of thirty (30) days to NDMCE, with the understanding that immediately upon receipt of such notice, all work being performed under this proposal or any portion of it shall cease. Before the end of such thirty-day period, NDMCE shall provide an invoice for all work completed and shall be compensated accordingly for all work accomplished by us prior to the receipt of such notice.
